PLAN (SP-101) FOR PROPERTY LOCATED ON THE WESTERLY WHEREAS, the Planning Commission of the City of Carlsbad did recei\ 4 Plan to develop a twenty (20) unit apartment complex on property describe( 5 a verified application from ARTHUR L. DOTY, requesting approval of a Spec. 6i 7' 8 ~ That portion of Tract 238 of Thum Lands, Map 1681 , in the City of Carlsbad, County of San Diego, State of California, being parcels 8 & 9, Book 206, Page 112, of the Assessor's Map of San Diego County, more particularly described in the application on file in the City Planning Office; and, I 9 WHEREAS , on February 13, 1973 a duly advertised Publ ic Hearing was '10 continued to April l0th.to allow for full 'Commission vote. Ori April lO,l9; 13 ,Hearing was continued to March 27, 1973 due to illness of .appl icant and ft 12 not present to answer queries of the Commission. On Feb. 27,1973 Publ' ll'was to consider the proposed Specific Plan, said hearing being continued as A! 14;,hearing was finally held to consider the Specific Plan, and; 15 WHEREAS, the Planning Commission did find the following facts and 16 1. The herein described project is consistant with the 18 general purpose of Title 21 of the Carlsbad Municipal Code: 17 reasons to be present which in their opinion are necessary to carry out tk 19 WHEREAS, said application has complied with the requirements of tht 22 to the Publ ic Health, Safety and General Welfare, and; 21 2. The herein described project will not be detrimental 20 goals and objectives of the City's adopted General Plan. 23 I' of .Cad sbad that it does hereby recommend to the City Counci 1, approval c 26 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the C 25 declared to have a "non-significant" impact on the environment. 24 "City of Carlsbad Environmental Protection Ordinance of 1972" and has bec 2711 herein described Specific Plan, subject to the following conditions: 28 29 30 31 32 1. The City Council Ordinance which approves this Specific P1 labeled Exhibit "A" & "Bl', supercedes Ordinance No. 9233. 2. All land and/or easements required by this Ordinance st. be granted to the City of Carlsbad without cost to the Ci tJ and free of all 1 iens and encumbrances. 4. The project shall be constructed with the density shown on the Specific Plan, and shall be constructed in no less a manner than shown on the exhibits labeled "A" & ' 5. Final elevation and plot plans shall be reviewed by thc Director of Planning to ensure conformity with the intent ( this Specific Plan. 6. The off-street parking facilities shall be constructed accordance with Chapter 21.44 of the Carlsbad Municipal Cod 7. Side and rear yards shall be fenced with a six foot his solid fence or equal, in compatible materials with those used in the main structure. 8. Exterior lighting shall be provided in the off-street parking areas, and shall be shielded so as not to shine or glare on adjacent properties. 9. A parcel map shall be prepared , filed with the City of Carlsbad and recorded prior to the issuance of any buildin5 permit whatsoever. 10. A strip of land ten (10) feet wide shall be granted to the City for street purposes along Harrison Street. 11. Full subdivision improvements shall be constructed to include the undergrounding of a1 1 utilities. 12. An approved Fire Hydrant shall be-:installed on the wes side of Harrison Street, at the intersection of Locust Aven type and installation to the satisfaction of the Fire Chie 13. On-site fire protection appurtenances s.hal1 be constru in accordance with Fire Department requirements to the sati faction of the Fire Chief. Said fire protection appurtenan shall be installed and functioning prior to framing constru 14. All buildings shall be connected to the facilities of City of Carlsbad 'dater Department. 15. All buildings shall be connected to the City of Carlst Public Sewer System. 16. The applicant shall obtain a mutual agreement with the Carlsbad Unified School District to provide for future school requirements that will result from the construction of these residences.
