APPLICANT: COVINGTON BROTHERS/OCCIDENTAL PETROLEUM LAND AND DEVELOPMENT CORPORATION. PLAN (SP-122) TO ALLOW FOR A 300 UNIT TOWNHOUSE 6 I1 7 II WHEREAS, the Planning Commission of the City of Carlsbad did rec 8 on approximately 57.202 acres of land, said property general ly located 01 11 (SP-122) to allow for development of a 300 unit townhouse cluster develol 10 LAND AND DEVELOPMENT CORPORATION, requesting approval of a Specific Plan 9 a verified application from COVINGTON BROTHERS/OCCIDENTAL PETROLEUM A portion of Section 28, Township 12 South 14 more particularly described as: 13 the south side of Poinsettia between the San Diego Freeway and Lagoon La1 12 15 I Range 4 West, San Bernardino Base and Meridian, 16 17 City of Carlsbad, County of San Diego, State of California, and; 18 and; 20 Impact Report for this project and approved same as presented (€IS No. 1t 19 WHEREAS, the Planning Commission did consider the Final Environmt 21 WHEREAS, THE Planning Commission did hold a duly noticed public 22 arguments, if any, of all persons who desired to be heard, said Commissic 23 hearing on June 26, 1973, and upon hearing and considering the testimony general purpose of Ordinance No. 9060: 26 for approval of this Specific Plan necessary to carry out the provisions 25 did find the following facts and reasons to exist which make the recommer, 24 27 28 29 30 31 1. Conformance of the Plan to the Occidental Petroleum Master Plan and the General Plan commitment in terms of density and of development. 2. Conformance of the zoning ordinance considerations for proper located in the P-C zone. 3. All areas shown as parking areas shall be surfaced with concrete and shall be visably marked outlining individual pa spaces and traffic flow. Said surfacing and marking shall i: completed prior to final inspection of the structure or stru by the Building Department. The surface shall be kept in a reasonably good state of repair at all times. All garage fl and/or carport floors shall be a minimum of portland concret cement . 7. Prior to obtaining a building permit and within 30 days the applicant shall file with the Secretary of the Planning Commission, written acceptance of the conditions stated here 25 26 27 28 29 30 31 32 8. Compliance with and execution of a1 1 conditions 1 isted h shall be necessary prior to obtaining final building inspect clearance. Deviation from this requirement shall be permitt only by written consent of the Planning Director. 9. Any mechanical and/or electrical equipment to be located roof of the structure shall be screened in a manner acceptab the Planning Director. Detailed plans for said screening sh submitted, in triplicate, to the Planning Director. 10. All incombustible trash enclosures shall be provided of and location acceptable to the Planning Director, and said a shall be enclosed with a fence and/or wall of sufficient hei to ade.quately shield the area. A detailed landscape and sprinkler plan prepared by a landscape architect, shall be submitted to the Planning air for consideration and approval. Special attention shall be to buffering the project with landscaping from the influencl the freeway . 12. Prior to the issuance of any permits , all exterior bui elevations and specific floor plans shall be submitted to t ~ Planning Director for consideration and approval. 6 7 8 9 10 11 12 13 14 13. Prior to final building inspection clearance, all land shall be installed. Said landscaping shall, at all times, maintained in a manner acceptable to the Planning Director. 14.All landscape areas in parking lots shall be enclosed by raised concrete curb or low wall. All planters adjacent to right-of-way shall be constructed with weep holes per speci. of the City Engineer. 15. The applicant shall establish and hereafter maintain a Homeowners Association for the purpose of maintaining all 1; scaped areas , the lake, private roadway and driveways. 16. All utilities, including electrical, telephone and telc shall be installed underground and/or shall be completely cc cealed from view. 18. The applicant shall install all required fire hydrants' and dry-stand pipes prior to framing construction, and said appurtenances shall be functional prior to commencing such v 19 20 19. Prior to the issuance of any permits, the applicant sha cause the dedication to the City of Carlsbad that area indic on the plot plan labeled Exhibit "A" as Future Park Dedicati 21 22 23 24 25 20. Prior to the issuance of any permits, the applicant sha submit a Precrise Plan of all recreation areas to the Plannin Director for consideration and approval. Said plan shall cc to the recreation areas as shown on Exhibit "A", and in addi shall show a minimum of 12 individual children play areas. 21.
