HomeMy WebLinkAbout1973-07-10; Planning Commission; Resolution 928r *: I! e 0 .r I I 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 928 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A OF 331 UNITS ON PROPERTY GENERALLY LOCATED ON THE WESTERLY SIDE OF AND ADJACENT TO EL CAMIMO REAL, CONSISTING OF APPROXIMATELY 63 ACRES. SAID DEVELOPMENT IS TO BE KNOWN AS "CARLSBAD PALISADES". SPECIFIC PLAN (SP-115) TO ALLOW FOR THE DEVELOPMENT 6 located on the westerly side of and adjacent to El Camino Real, approxim 9 Plan (SP-115) to allow for the development of 331 units , on property gen 8 a verified application from DOUGLASS-PACIFIC requesting approval of a Sp '7 WHEREAS, the Planning Commission of the City of Carlsbad did rece lo 200 feet northerly of the intersection of Kelly Drive and El Camino Real l1 consisting of approximately 63 acres, to be known as "Carlsbad Palisades I-2 and more particularly described as: 13 Portion of Lot "I" of Rancho Agua Hedionda 14 15 Map No. 823, in the City of Carlsbad, State of California. 16 17 WHEREAS, the Planning Commission, at a previous meeting, did cons and approve the Final Environmental Impact Report for this project, and, 18 MHEREAS, the Planning Commission did hold a duly noticed public h I' and upon hearing and considering the testimony and arguments, if any, of 2o persons who desired to be heard, said Comission did find the following . 21 and reasons to exist which make the recommendation for approval of this 22 Specific Plan (SP-115) necessary to carry out the provisions and general 23 of Ordinance No. 9060: 24 25 26 located in the P-C Zone District. 27 28 29 1. The Specific Plan is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Final Revised Exhibit A. The location of all bdildings, fences, signs roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the plot plan labeled Final Revised Exhibit A., except or unless indicated otherwise herein. 2. . The total number of units shall be 1 imited to 331 dwell ing units. 3. Prior to the issuance of any permits, a Tentative Map shall be approved by the City. 4. Prior to obtaining a building permit, and within 30 days hereof, the applicant shall file with the Secretary of the Planning Commission, written acceptance of the conditions stated herein. 5. Compliance with and execution of all conditions listed' hereon shall be necessary prior to obtaining final building inspection clearance. Deviation from this requirement shall be permitted only by written consent of the Planning Director. 6. Prior to the issuance of any permits, a detailed landscape and sprinkler plan prepared by a landscape architect shall be submitted to the Planning Director for consideration and approval. 7. Prior to final building inspection clearance, all land- scaping shall be installed. Said landscaping shall, at all times, be maintained in a manner acceptable to the Planning Director. 8. Prior to the issuance of any permits, the applicant shall enter into a mutually acceptable agreement with the City of Carlsbad Unified School District to provide for future school requirements that will result from the proposed development. 9. All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 10. All utilities, including provisions for cable TV shall be placed underground and/or shall be completely concealed from view. 11. Prior to the issuance of any permits, detailed building elevations and floor plans of all buildings shall be submitted to the Planning Director for consideration and approval. 12. All areas shown as parking areas shall be surfaced with asphaltic concrete and shall be visibly marked outlining in- dividual parking spaces and traffic flow. Unless the construction of the structure or facility is commenced not later than twelve months (12) after the date the approval is granted and is diligently pursued thereafter, . approval will automatically become null and void. 14.
