HomeMy WebLinkAbout1973-07-10; Planning Commission; Resolution 929,~. * I ' I1 e e 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION NO. 929 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A OF 331 UNITS ON PROPERTY GENERALLY LOCATED ON THE WESTERLY SIDE OF AND ADJACENT TO EL CAMINO REAL, APPROXIMATELY 200 FEET NORTHERLY OF THE INTERSECTION OF KELLY DRIVE AND EL CAMINO REAL, CONSISTING OF APPROXIMATELY 63 ACRES. SAID DEVELOPMENT IS TO BE KNOWN AS "CARLSBAD PALISADES". TENTATIVE MAP (CT 73-8) TO ALLOW FOR THE DEVELOPMENT I 7 WHEREAS, the Planning Commission of the City of Carlsbad did recei 8 33. units, on property generally located on the westerly side of , and adjacen 10 Tentative Subdivision Map (CT 73-8), to allow for the development of 331 9 a verified application from DOUGLASS-PACIFIC, requesting approval of a as Carlsbad Palisades , and more particularly described as: IS Drive and El Camino Real, consisting of approximately 63 acres, to be knc I,2 El Camino Real , approximately 200 feet northerly of the intersection of K 14 Portion of Lot "I" of Rancho Agua Hedionda 15 16 Map No. 823 , in the City of Carl sbad , State of Cal ifornia. 17 WHEREAS, at the regular meeting held on the 10th day of July, 1973 I-8 I' the Planning Commission did find that the subject Tentative Map does sub- State of California Subdivision Map Act; and, 2o stantially comply with the City of Carlsbad Subdivision Regulations and t 21 WHEREAS, the Planning Commission does find that the Provisions for 22 23 Design and Improvements of this Tentative Map are consistent with the Ger Plan of the City of Carlsbad, and, 24 WHEREAS, the Planning Commission, at a previous meeting, did consi 25 28 of Carl sbad that it does hereby recommend approval to the City Council of 27 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the C 26 and approve the Final Environmental Impact Report for this project, and, the City of Carl sbad, of the herein described Tentative Map (CT 73-8) , 29 subject tc the fulfillment of the following conditions: 30 xx I 31 32 xx xx I -1 - e 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 l5 I/ 1. Prior to any construction, the applicant shall submit plans to the appropriate entity providing domestic water to t proposed development, for its approval of the location, type and adequacy of water lines, and to this Fire Department for approval of the location of fire hydrants, 2. Prior to any construction, the applicant shall submit a grading and drainage plan to the City Engineer for his con- sideration and approval. 3. All fire protection appurtenances shall be constructed in accordance with City Fire Department requirements. 4. The applicant shall install all required fire hydrants an dry-stand pipes prior to framing construction, and said fire appurtenances shall be functional prior to commencing such wo 5. The applicant shall install a fully actuated traffic sign at the intersection of Tamarack Avenue and El Camino Real, w reimbursement as possible. A Future Agreement may be submitt as an a1 ternative. 6. The applicant shall install the remaining full half-stree improvements on El Camino Real (106' curb to curb) adjacent t the subdivision, including but not limited to curb and gutter sidewalk, paving and median curb. 7. Tamarack Avenue shall be installed as shown on the Tentat Map. 16 17 18 19 8. Street names shall be subject to the approval of the City Planning Department. 9. Tamarack Avenue shall have an 84 ft. right-of-way and sha be extended to Sky1 ine Drive, with full pub1 ic improvements. Qffsite, the improvements shall be installed wi:thin the exist right-of-way in a manner acceptable to the City Engineer. 20 21 10. A two inch A.C. overlay shall be placed on Birch Avenue between Skyline Drive and Sunnyhill Drive. 22 23 11 . Adequate parking space, subject to the approval of the Planning Director, shall be provided for the Park and Recreat areas. 24 I/ 12. Park-In-Lieu fees shall be granted to the City prior to recording the Final Map. 25 26 13. The full improvement of Tamarack Avenue (Birch Avenue extended) shall be included in the first phase of development 27 28 29 30 31 14. The development of the property described herein shall t subject to the restricttbns and limitations set forth herein which are in addition to all the requirements, limitations ar restrictions of all municipal ordinances and State and Federt statutes now in force, or which, hereafter may be in force fc the purpose of preserving the residential characteristics of adjacent properties. The C.C. & R's for this development shall be submitted t the Planning Director for review and approval prior to the issuance of any building permits. 16. All public improvements shall be made in conformity to tl City of Carlsbad Engineering Design Criteria and Standard Plal the Subdivision Ordinance and other City Standards, to the sa' faction of the City Engineer, and without cost to the City of Carlsbad, and free of all 1 iens and encumbrances. Improvemen' plans for water and sewer system shall meet the requirements I respective service districts. 17. All private driveways, which do not loop, shall be provil with turn-arounds in a manner acceptable to the City Fire Chi1 18. The Developer shall enter into a mutually acceptable agri ment with the Carlsbad'.Unified School District to provide for future school requirements that will result from the proposed devel opment. 19. If requested by the City Engineer, an amended Tentative P shall be submitted for approval by the City Engineer prior to preparation of the Final Map to assure compliance to all condf of approval. 20. All utilities, including provisions for cable TV shall be placed underground and/or shall be completely concealed from \ PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 10th day of J ' 1973, by the following vote, to wit; AYES: Commissioners Dominguez, Jose, Forman, Casler, Palmateer & L NOES: None ABSENT: Commissioner Irlrench. 23 24 25 ATTEST: 29 30 31 32
