'9-45 A RESOLUTION OF THE PLANNING COMMISSION'OF THE CITY OF CARLSBAD GRANTING A VARIANCE TO PERMIT A PANHANDLE LOT SPLIT ON PROPERTY GEYERALLY LOCATED ON THE NORTH SIDE OF KNOWLES AVENIJE, WESTERLY OF ELMWOOD STREET (CONSTANTINO MEDINA JR ... ... ... I (v-229) WHEREAS, pursuant to the provisions of Title 21 of the 7 for a Variance to permit a panhandle lot split on property 9 1973, hold a duly noticed public hearing, to consider a req 8 Carlsbad Municipal Code, the Planning Commission did on Aug 10 generally located on the north side of Knowles Avenue, westc 11 of Elmwood Street, and more particularly described as: I2 I Portion of Northwest one-quarter of Section 6, Township 12 South, Range 4 West, San Bernard-ino 13 Base & Meridian, in the City of Carlsbad, County of San Diego, according to the map thereof No. 4233, filed in the Office of the County Recorder of San Diego County, 25 October, 1875. 14 I 15 16 WHEREAS, the subject application is exempted from the Y 37 Code, and; 19 provision of Section 19.04.090 C.4 (iii) of the Carlsbad Mur x8 quirements of the Carlsbad Environmental Protection Ordinanc 20 WHEREAS, at said public hearing, upon hearing and consi 21 24 Variance necessary to carry out the provision and general pu 23 facts and reasons to exist which make the granting of said 22 all testimony and arguments, the Commission did find the fol 1. The proposed lot split conforms to the requirements 25 of Title 21 of the Carlsbad Municipal Code: of the City's panhandle lot policy. 26 27 2. The Variance is granted for the land described in application and any attachments thereto, and as shown o plot plan submitted labeled Exhibit A. Unless the use is inaugurated not later than one after the date the approval is granted and is diligen, pursued thereafter, this approval will automatically null and void. 3. Compliance with and execution of all conditions hereon shall be necessary otherwise specified, prior taining final building inspection clearance. Park-in-?ieu fees shall be granted to the City p recording the Final Map. 8. All public improvements shall be made in conform the City of Carlsbad Engineering Design Criteria and Plans, the Subdivision Ordinance and other City Stand the satisfaction of the City Engineer without cost to of Carlsbad, and free of all liens and encumbrances. Plans for water and sewer system shall meet the requi of the respective service districts. 9. Complete plans and specifications shall be submi required for checking and approval, before constructi improvements is commenced. The developer shall enter into a mutually accept agreement with the Carlsbad Unified School District t for future school requirements that will result from posed development.
