A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD ANNOUNCING ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF
(SINGLE FAMILY) TO P- ZC- i FOR ANDREkl MCREYNOLDS 29 ACRES OF LAND LOCA RLY OF AND ADJACENT TO LOWDER LANE, APPROXIMATELY 1000 FT. SOUTHERLY OF THE INTERSECTION OF LOWDER LANE AND PALOMAR AIRPORT ROAD. ANDREW MCREYNOLDS

7 THE CARLSBAD CITY PLANNING COMMISSION of the City of Carlsbad does
8 hereby resolve as follows :
9 WHEREAS, the Planning Commission did, on the 11th day of September,

southerly of the intersection of Lowder Lane and Pal omar Airport Road, a I.3
generally located easterly of and adjacent to Lowder Lane, approximatel; 1%
from R-1-10,000 (Single-Family) to P-M (Planned Industrial) on property I'J,
hold a duly noticed Public Hearing to consider a request for a change 01

a portion of Lot H, Rancho Agua Hedionda, Map 828, City of Carlsbad, County of San Diego and State of California.
WHEREAS, SAID application has complied with the requirements of the

Commission and City Council , and , 20
Environmental Impact Report had previously been accepted by the Plannin$ 19
"City of Carl sbad Environmental Protection Ordinance of 1972" and the
21 WHEREAS, at said Public Hearing, upon hearing and considering the

the approval of a change of zone necessary to carry out the provisions E 24
said Commission did find the fol1owi:ng facts and reasons to exist which 23
testimony and arguments, if any, of all persons who desired to be heard,

1. The proximity of the subject property to existing and proposed industrial and commercial development makes the property conducive to industrial uses. The physical sepal of the subject property from proposed residential developr to the south lessens the impact of any industrial developn on the subject property.

2. The location of the subject property on a major collec within a 1000 ft. of a major arterial which immediately converts to a freeway, makes the site sui table for industv uses.

3. The location of the site within a flood plain and the fluence of the Encinitas sewer plant located westerly of . freeway on the subject property does not make the site col for residential development.
4. The location of the subject property within the infll area of the Palomar Airport does not make the site conduc. for residential development.
5. The application of a P-M Zone designation in 1 ieu of . requested M. Zone District, would give the City greater c( to guarantee compatibility of any development to existing and proposed development. In addition, on-site concerns \ regard to Encinas Creek will be guaranteed when precise dc velopment plans are commenced. Finally, any potential prc
with regard to circulation and required improvements can I resolved prior to development.
6. The non-conformance of the proposed development to the present General Plan commitment results from the lack of ( of the Palomar Airport to any development within its inflt area. Rather than to approach this situation incramentall since it concerns an area alot larger than the subject prc staff would recommend that it be resolved as a part of thc on-going General Plan revision.
