HomeMy WebLinkAbout1973-09-11; Planning Commission; Resolution 958* "' * 1 2 3 4 5 6 %NNING CO~MISSION RESOLUTION @ 958 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF AN AMENDMENT TO CITY OF CARLSBAD ORDINANCE N0.9332 ADOPTING THE MASTER PLAN FOR RANCHO CARRILLO PARTNERSHIP TO INCLUDE AN AMENDMENT TO THE MASTER PLAN AND 5Y ADDING CONDITIONS OF APPROVAL. SAID PROPERTY CONSISTS OF 853 ACRES OF LAND LYING SOUTHER\ AND NORTHERLY OF PALOMAR AIRPORT ROAD, AND APPROXIMATELY TWO MILES EAST OF EL CAMINO REAL. MHEREAS, the City Council of the City of Carl sbad, California did 7 a public hearing on October 3, 1972 and granted an appeal , per Resolutic ll 8 said request having been denied by the City of Carl sbad Planning Commiss 9 I 2083, by RANCHO CARRILLO PARTNERSHIP for adoption of their Master Plan ( 10 their regular meeting of August 8, 1972; and, 11 WHEREAS, the Planning Commission of the City of Carlsbad, Califorr 3.2 amendment to the Master P1 an and by adding conditions of approval ; and , 14 ment to the Master Plan (MP-139) for RANCHO CARRILLO PARTNERSHIP to incl 13 hold a duly noticed public hearing on September 11, 1973 to consider an I!5 [ NOM, THEREFORE, BE IT RESOLVED that the Planning Commission does h 16 1 to include the following Conditions of Approval : 17 1 recommend to the City Council that it Amend City of Carlsbad Ordinance N I 18 19 20 21 I. The Master P1 an is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A Revised, B. and B-1. Th location of a1 1 buildings , fences , signs , roadways , parking ar landscaping and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A Revi B. and B-1, except or unless indicated otherwise herein. That Parcel K, as indicated on Exhibit A Revised, prior to of the Final Map for the first phase of development, shall be in fee with a policy of title insurance to the City of Carlsbal land dedication requirements in satisfaction of the park-in-li ordinance for the first tentative map, shall be satisfied from K. The balance of Parcel K may be reserved by the City to be upon in satisfaction of park requirements for future tentative for the Master Plan development. The existing improvements on K shall be appraised at the developer ' s expense by an appraise selected by the City, and the established value as approved by City Council shall be available as a prepayment of park-in-1 ie to be drawn upon in satisfaction of the total parks requiremen property to be developed within the Master Plan area. Any devc may be credited in terms of meeting the proportional share of ' parks requirement, from the balance of Parcel K, and the park- fees prepayment resulting from the appraisal of the improvemen, City shall elect.
