I ;f' 4 'I 1 2 31 I 4 5 ' PLANNING COMMISSION RESOLUTl q N N0ag61 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, THE DEVELOPMENT OF A 16 CONDOMINIUM UNITS ON .8 ACRES OF LAND, GENERALLY LOCATED ON THE SOUTH SIDE OF GIBRALTER STREET, WEST OF ROMERIA STREET, APPLICANT: Herb Hops for John A. & Louise Burnett APPROVAL OF A TENTATIVE MAP (CT 73-28) TO ALLOW e/ 7 WHEREAS, the Planning Commission of the City of Carlsbad did receiv a verified application from HERB HOPS, for JOHN A. AND LOUISE BURNETT, r ing approval of a tentative subdivision map (CT 73-28) to allow the deve ment of 16 condominium units, on .8 acres of land, generally located on south side of Gibralter Street, west of Romeria Street, and further desc 8 9 10 11 IZj/ as: l3 (1 Lots 394 and 395, La Costa South Unit No. 5, per Map No. 6600, in the City of Carlsbad, State of California. 14 ' WHEREAS, said application has complied with the requirements of the l5 Director has declared that the proposed development would have a "non-si1 I.t3 "City of Carl sbad Environmental Protection Ordinance of 1972" and the P1, ''(1 impact on the environment; and,. 1811 WHEREAS, the Planning Commission did find that the subject Tentativ ''11 Map does substantially comply with the City of Carlsbad Subdivision Regu' 20// and the State of California Subdivision Map Act; and, 21j/ WHEREAS, the Planning Commission does find that the provisions for ( 22 of Carlsbad, that it does hereby recommend approval to the City Council ( 25 24 of the City of Carlsbad, and; 23 and improvements of this tentative map are consistent with the General P' I the City of Carlsbad , of the herein described Tentative Map(CT 73-28) , st 26 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Ci 27 11 to the fulfillment of the following conditions: 28 29 30 33. 32 1. The development of the property described herein shall be ! to the restrictions and limitations set forth herein which are addition to all the requirements, limitations and restrictions municipal ordinances and State and Federal statutes now in for( which, hereafter, may be in force for the purpose of preservinc residential characteristics of adjacent properties. 2. The Developer shall enter into a mutually acceptable agrec with the Encinitas Union and San Dieguito Union School Distric to provide for future school requirements that will result frc proposed development. 4. In order to provide for reasonable fire protection during construction period, the subdivider shall maintain passable ve access to all buildings, and adequate fire hydrants with requ flows shall be installed as recommended by the Fire Department 6 7 8 9 10 5. All pub1 ic improvements shall be made in conformity to the Carlsbad Engineering Design Criteria and Standard Plans, the $ division Ordinance and other City Standards, to the satisfacti of the City Engineer, without cost to the City of Carlsbad, ar of all liens and encumbrances. All utilities, including provisions for cable TV, shall be underground and/or shall be completely concealed from view. 8. No trenching shall be allowed in Gibralter Street. All ut connections shall be approved by the City Engineer. 9. The developer shall create, and hereafter maintain, a Home Association for maintenance of landscaping, drainage and recre areas. 1 I.6 i l7 I 10. The C.C. & R's for this development shall be submitted to Planning Director for review and approval prior to the issuancl any building permits.
