HomeMy WebLinkAbout1973-09-25; Planning Commission; Resolution 962" *x 1 2 3 4 5 6 7 a 0 PLANNING COMMJ,SSIQN RESOLUTION NO. 962 ... :."~.. , j_,; ,,., A RESOLUTION OF THE PLANNING COMPlISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP (CT 73-20) TO ALLOW THE DEVELOPMENT OF PHASE TWO OF THIS PROJECT, CONSISTING OF TWO UNITS ON PROPERTY GENERALLY LOCATED SOUTHERLY OF AND ADJACENT TO LA COSTA AVENUE, IMMEDIATELY WESTERLY OF THE PRESENT WESTERLY MOST EXTENSION OF LEVANTE STREET, TO BE KNOWN AS SPANISH VILLAGE WEST - APPLICANT: LA COSTA LAND CO. WHEREAS, the Planning Commission of the City of Carl sbad 9 did recei * tentative map (CT 73-20) to allow for construction of Phase I1 of the 9 verified appl ication from LA COSTA LAND COMPANY requesting approval of z lo more particularly described as: l3 most extension of Levante Street, to be known as Spanish Vi1 lage West, z X? and adjacent to La Costa Avenue, irnnediately westerly of the present we: Kt. project , consisting of two units, on property generally located souther1 14 15 16 17 Portion Section 35 & 36, Township 12 South Range 4 West, and Portion of Section 2, Township 13 South, Range 4 West, S.B.M., City of Carlsbad, County of San Diego, State of California, WHEREAS, the Planning Commission did, on September 25, 1973, consic 18 as presented, and; 19 the final environmental impact report for this project, and did accept : 20 WHEREAS, the Planning Commission did find that the subject Tentati\ 21 the fulfillment of the following conditions: 29 City of Carlsbad , of the herein described Tentative Map (CT 73-20) , sub, 28 Carlsbad that it does hereby recommend approval to the City Council of 27 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the C 26 of the City of Carlsbad, and; 25 and improvements of this Tentative Map are consistent with the General I 24 WHEREAS, the Planning Commission does find that the provisions for 23 and the State of California Subdivision Map Act; and, 22 does substantially comply with the City of Carlsbad Subdivision Regulat. 30 31 xx 32 J i b 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 e 0 1. Prior to approval of the Final Map on Unit No. 2, the Co[ shall elect either one of the following to be accompl i shed.: (a) The City Council shall have considered and approved the parks program for the La Costa area and all required parks have been dedicated to the City to meet the Parks Ordinance requirements for all proposed development in tl area covered by the La Zosta Master Plan. (b) Lot 135 shall be dedicated to the City of Carlsbad for Park' purposes. 2. The open space easement indicated on Lots 119, 120, 122, and 126 shall be dedicated to the City of Carlsbad.. 3. The applicant shall install a fully actuated traffic sigr the proposed intersection of Levante Street and El Camino Re; as otherwise directed by the City Engineer. 4. El Camino Real shall be dedicated and improved on the ba: of 126 ft. right-of-way to City standards and specifications. 5. La Costa Avenue shall be improved in a manner acceptable City Engineer. 6. Prior to the issuance of any permits, the total property annexed to the Leucadia County Water District. 7. The development of the property described herein shall bc to the restrictions and limitations set forth herein which a\ addition to all the requirements, limitations and restrictior all municipal ordinances and State and Federal statutes now i force or which, hereafter, may be in force for the purpose of serving the residential characteristics of adjacent propertic 8. The developer shall enter into a mutually acceptable agrc with the Encinitas Union and San Dieguito Union School Distri provide for future school requirements that will result from proposed development. Lot 134 as indicated on the Tentative shall be set aside for school purposes under provisions of ti. California Map Act. 10. A1 1 pub1 ic improvements shall be made in conformity to 1 of Carlsbad Engineering Design Criteria and Standard Plans, I division Ordinance and other City Standards to the satisfact- the City Engineer, without cost to the City of Carlsbad, and of all liens and encumbrances. Improvement plans for water a sewer system shall meet the requirements of the respective SE districts. 11. All utilities, including provisions for cable TV shall t underground and/or shall be completely concealed from view. 12. Ornamental street lighting shall be provided for as reql by Municipal Ordinance Code. Complete plans and specifications shall be submitted as for checking and approval, before construction of any improv is commenced. The subdivider shall submit the original draw revised to reflect as-built conditions, prior to acceptance subdivision i.mprovement by the City. 14. All facilities provided to adequately control drainage [ subject property shall be maintained by the property owner(s perpetuity. 16. The subdivider shall dedicate to the public, all rights and egress from lots abutting upon restricted access streets over and across the lines of said lots abutting said streets This dedication shall be so designated on the certificate shl the Final Map with the intent that the owners of said lots w no rights of access whatsoever to said streets and roads. T~ "access rights dedicated to the City" shall be lettered alon road adjacent to the lots affected on the map proper. This requirement shall apply to Lots 108-110 along El Camino Real ! lots adjacent to La Costa Avenue. 17. Street names shall be subject to approval and shall be ( in accordance with the standards and policies adopted by the Commission on file in the Planning Department. Said names st approved by the Planning Director prior to recordation of thc Map. 18. If required by the City Engineering Office, the improver plans shall include a report of a geological investigation al complete grading plan of the entire site. The report and pli be prepared by Civil Engineers licensed by the State of Cali. and experienced in erosion control , who shall be acceptable .
