COPjMISSION RESOLUTION N.O. 965 .. .- i a 2 3 4i 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMPIENDING TO THE CITY COUNCIL, 39 SINGLE FAMILY LOTS ON 11.7 ACRES OF LAND, GENERALLY LOCATED ON THE NORTH END OF CORDOBA PLACE BETWEEN HILLSIDE AND AVILA STREETS, TO BE KNOWN AS LAGUNA RIVIERA NO. 8, APPLICANT: JERRY L. ROMBOTIS. APPROVAL OF A TENTATIVE MAP (CT 73-5) TO CREATE WHEREAS, the Planning Commission of the City of Carlsbad did receiv 8 a verified application from JERRY L. ROMBOTIS, requesting approval of a t~ tentative map (CT 73-5) to create 39 single family lots on 11.7 acres of 1 land, generally located on the north end of Cordoba Place between Hillsi and Avila Streets, to be known as Laguna Riviera No. 8, and more particu 10 11 described as: 12 13 I A portion of Lot "I" of Rancho Agua Hedionda, per Map No. 823 in the City of Carlsbad, State of California. 14 WHEREAS, said application has complied 'with the requirements of the 15 significant" impact on the environment; and, 17 Director has declared that the proposed development would have a "non- 16 "City of Carlsbad Environmental Protection Ordinance of 1972" and the Pli S8 WHEREAS, the Planning Commission did find that the subject Tentativr 19 and the State of California Subdivision Map Act; and, 20 Map does substantially comply with the City of Carlsbad Subdivision Regul 21 WHEREAS, the Planning Commission does find that the provisions for ( 22 to the fulfillment of the following conditions: 27 City of Carlsbad, of the herein described Tentative Map (CT 73-5), subjec 26 Carlsbad, that it does hereby recommend approval to the City Council of t 25 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Ci. 24 of the City of Carlsbad, and; 23 and improvements of this Tentative Map are consistent with the General P' 28 29 30 31 1. The development of the property described herein shall are in addition to all the requirements, 1 imitations and 1 strictions of all municipal ordinances and State and Fedev statutes now in force, or which, hereafter, may be in for( the purpose of preserving the residential characteristics adjacent properties. 4. The Developer shall enter into a mutually acceptable a with the Carlsbad Unified School District to provide for f school requirements that will result from the proposed dev subject to the restrictions and limitations set forth her( 7 8 9 10 fl 12 93 14 15 16 5. If requested by the City Engineer, an amended Tentativ shall be submitted for approval by the City Engineer prior preparation of the Final Map to assure compliance to a1 1 c of approval. 6. In order to provide for reasonable fire protection dur construction period, the subdivider shall maintain passabl vehicular access to all buildings and adequate fire hydrar required fire flows shall be installed as recommended by t Department. 7. If required by the City Engineering Office, the improv plans shall include a report of a geological investigation complete grading plan of the entire site. The report and shall be prepared by civil engineers licensed by the State California and experienced in erosion control who shall be acceptable to the City Engineer, and they shall certify th have investigated the site and prepared data with full con of the consequences to the included and neighboring proper l7 I 38 1 8.
