'967 I A RESOLUTION OF THE PLANNXNG CO?$"SSXON OF THE CITY OF CARLSBAD, CALIFORNTA, RECONMENDING TO THE CKTY C0UNCI.L THAT THE PROPOSED GRANTING OF A CHANGE OF ZONE FROM R-1 and C-1 to C-2 (ZC-1211 ON PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF PI0 PIC0 DRIVE AND ELPI AVENUE, BE COMPLETED. WEREAS, on July 10, 1973 and August 14, 1973, a duly advertised PI 6 ' two-story complex to be used for commercial and professional activities €I Change of Zone from R-1 and C-1 to C-2 (ZC-121) , to allow construction ( '? hearing was held before the Planning Commission to consider a request fc property generally located at the southeast corner of the intersection I 301i Pi0 Pic0 and Elm Avenue, and more particularly described as: LE l2 I I 13 14 15 That portion of Lots 17 to 24, inclusive, in Block 86 of the Town of Carlsbad, in the County of San Diego, State of California, according to map thereof, No. 535, filed in the Office of the County Recorder of San Diego County, May 2, 1888: TOGETHER with a portion of Tract 115 of the Town of Carlsbad, County of San Diego, State of California, according to Map thereof No. 775, filed in the Office of the County Recorder of San Diego County, February 15, 1894. 16/j WHEREAS, at the conclusion of said hearing on August 14, 1973, the I.7 I/ commission of the City of Carl sbad did adopt Resolution No. 942 recommer '' 19 Denial of the zone change, and; 1 WHEREAS, on September 25, 1973, the Planning Commission was present 26 to the Planning Commission for report; and, 25 and indicated their intent to grant said appeal , and referred the matter 24 1 and heard all persons interested in or opposed to the proposed change of 23 held a public hearing on the appeal of said Denial , received all recommc 22 WHEREAS, on September 4, 1973 the City Counci 1 of the City of Carl 5 21 of Carlsbad Environmental Protection Ordinance of 1972" and; '' WHEREAS, said application has complied with the requirements of thc I1 27 (1 report describing City Council Action regarding the COLONIAL MALL/ROBERl 28 29 WATSON'S request for a Change of Zone. fol1 owing reasons : 31 the City of Carlsbad grant the change of zone from R-1 and C-1 to C-2, f 30 NOW, THEREFORE, the Planning Commission recommends the City Council 52 xx xx r( e -** 1 e 0 I I 7 2 3 4 51 6 7 a 9 10 11 12 13 14 15 16 17 1. The influence of the Civic Center development could reasonably extend along Pi0 Pic0 southerly to Oak Avenue. In addition, the impact of the freeway and the estimated traffic on Pi0 Pic0 could effect the subject parcel to th degree that the site would not be considered appropriate residential activity. A professional /commercial activitj the other hand, would be less affected. 2. As a part of the upcoming General Plan Revision and Z Ordinance Revision, staff envisions the establishment of civic center overlay zone concept on all the property sur the civic center area. A majority of the restrictions of zone will deal with design and such an application on the property will further guarantee the compatibility of any velopments to the surrounding development. 3. The existence of commercial zoning and uses to the we the subject parcel and its location adjacent to a frontag road of a State freeway and a collector street (Elm Avenu considered to be sufficient reasons for a finding that th General Plan commitment for the area is not realistic. I this incompatibility is part of a larger area of incompat which includes the Civic Center area and the full length 1 Pi0 Pic0 Drive, Staff would not recommend a General Plan amendment for just the subject siet at this tjme. Rather a part of the pending total general plan revision, a1 1 t inconsistencies will be eliminated. 4.
