HomeMy WebLinkAbout1973-09-25; Planning Commission; Resolution 968ll 2 3 4 5 o PLANNING COMMISSION RESOLU #k NO: 968 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD , CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL THAT THE PROPOSED GRANTING OF A CHANGE OF ZONE FROM NORTH EAST CORNER OF THE INTERSECTION OF OAK AVENUE AND PI0 PIC0 DRIVE, BE COMPLETED. THE MALONE COMPANY , ET AL. R-3 to C-2 (ZC-122) ON PROPERTY GENERALLY LOCATED AT THE WHEREAS, on July 10, 1973 and August 14, 1973, a duly advertised Pt 6 section of Pi0 Pic0 Drive and Oak Avenue, and more particularly describt '9 building, on property generally located at the north east corner of the 8 change of zone from R-3 to C-2, to allow construction of a two-story of1 ?' 1 Hearing was held before the Planning Commission to consider a request fc 10 11 Parcel "A" of Parcel Map No .' 71 6, filed in the Office of the Recorder of San Diego County, State of California; and, 12 WHEREAS, at the conclusion of said hearing on August 14, 1973, the I.3 Denial of the zone change; and, l4 Commission of the City of Carlsbad adopted Resolution No. 943, recommenc 15 WHEREAS, on September 4, 1973, the City Council of the City of Carl 17 WHEREAS, said application has complied with the requirements of thc I.6 of Carl sbad Environmental Protection Ordinance of 1972" and; l8 21 and indicated their intent to grant said appeal, and referred- the matte 2o and heard a1 1 persons interested in or opposed to the proposed change of l9 held a pub1 ic hearing on the appeal of said Denial, received all recomrne 23 WHEREAS, on September 25, 1973 the Planning Commission was present€ 22 back to the Planning Commission for report; and, report describing City Counci 1 Action regarding The Malone Company reque 24 Change of Zone. 25 NOW, THEREFORE, the Planning Commission recommends the City Counci 26 the City of Carlsbad to grant the change of zone from R-3 to C-2, for tk 27 fol1 owi ng reasons : 28 29 30 31 52 1 . The influence of the Ci:vi.c Center development could rc extend along Pi0 Pic0 southerly to Oak Avenue. In addjtic impact of the freeway and the estimated traff.ic.on Pi0 Pic effect the subject parcel to the degree that the site woul be considered appropriate for a residential activity. A p 0rfic.e activity on the other hand would be less affected also have less of an impact on adjacent residential proper the activity is normally limited to 8-5 weekdays and does the amount of traffic-that would be found with a retail-cc use such as a restaurant. Ordinance Revision, staff envisions the establishment of a ci\ center overlay zone concept on all the property surrounding ti civic center area. A majority of the restrictions of this ZOI will deal with design and such an application on the subject 1 will further guarantee the compati bil i ty of any development tc surrounding development . 5 6 7 8 9 10 11 12 13 I4 I 3. The existence of commercial zoning and uses to the north z of the subject parcel and its location adjacent to a frontage a State freeway are considered to be sufficient for reasons fc finding that the present General plan commitment for the area realistic. In that this incompatibility is part of a larger 2 of incompatibility which includes the Civic Center area and tk length of Pi0 Pic0 Drive, Staff would not recommend a General amendment for just the subject site at this time. Rather, as of the pending total general plan revision, all these inconsis will be eliminated. 4. In many ways, the potential use requested is less intense is possible under the existing R-3 Zoning designation which w( permit up to a total of 12 dwelling units on the site. 5.
