HomeMy WebLinkAbout1973-09-25; Planning Commission; Resolution 970I' j I_ x. $ PLANNING CO~MISSION RESOLUI)N NO. 970 1 2 3 *I 5 6 7 8 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, THE DEVELOPMENT OF PHASE TWO OF THE OVERALL DEVELOPMENT CONSISTING OF TMO UNITS ,ON APPROX. 96 ACRES OF LAND, ON PROPERTY GENERALLY LOCATED SOUTHERLY OF AND ADJACENT TO LA COSTA AVENUE, IMMEDIATELY WESTERLY OF THE PRESENT WESTERLY MOST EXTENSION OF LEVANTE STREET, TO BE KNOWN AS APPROVAL OF A SPECIFIC PLAN (SP-119) TO ALLOW SPANISH VILLAGE WEST. - APPLICANT: LA COSTA LAND CO. WHEREAS, the Planning Commission of the City of Carlsbad did recei 9 10 verified application from LA COSTA LAND COMPANY, requesting approval of and more particularly described as: 13 immediately westerly of the present westerly most extension of Levante 12 on property generally located southerly of and adjacent to La Costa Ave 11 Specific Plan (SP-119) to allow construction of Phase I1 of this projec 14 15 16 17 Portion Section 35 & 36, Township 12 South, Range 4 West, and Portion of Section 2, Township 13 South, RAnge 4 West, S.B.M., City of Carlsbad, County of San Diego, State of California WHEREAS, the Planning Commission did- consider this applicant's Fi' I 18 Environmental Impact Report and accepted same as was presented, and; 19 WHEREAS, the Planning Commission did hold a duly noticed public he 20 21 and upon hearing and considering the testimony and arguments, if any, o No. 9060: 24 Plan necessary to carry out the provisions and general purpose of Ordin 23 and reasons to exist which make the recommendation for approval of this 22 persons who desired to be heard, said Commission did find the following 25 26 27 28 29 1. The approval of a Specific Plan is granted for the la] described in the application and any attachments thereto, as shown on the plot plan submitted labeled Final Revised Exhibit A, dated Sept. 17, 1973. The location of all bui fences , signs, roadways , parking areas , landscaping and 0' facilities or features shall be located substantially as on the plot plan labeled Final Revised Exhibit A, dated SI 17, 1973, except or unless indicated otherwise.herein. 2. Prior to the development of each of lots 108-135, a s plan of the proposed development shall be submitted to thl Planning Commission and City Council for consideration an( 3. Any minor change may be approved by the Planning Dire( Any substantial change will require the filing of an appl. for an amendment to be considered by the Planning Commiss. 4. All requirements of any law, ordinance or regulation ( State of California, City of Carlsbad and any other govel mental entity, shall be complied with. 5. No signs or advertising of any type whatsoever shall I erected or instal led until plans therefore have been apprc by the City of Carlsbad. 6. Prior to obtaining any permits, and within 30 days he1 the applicant shall file with the Secretary of the Plannil Commission written acceptance of the conditions stated he1 7. Compliance with and execution of all conditions listec shall be necessary unless otherwise specified, prior to ot final building inspection clearance. Deviation from this quirement shall be permitted only by written consent of tt Planning Director. 8. A detailed landscape and sprinkler plan prepared by a scape architect shall be submitted to the P1 anning Directc for consideration and approval. Said plan shall be for a1 areas within the development. 9. Prior to inspection clearance, all landscaping shall t installed. Said landscaping shall, at all times, be main1 in a manner acceptable to the Planning Director. 10. All uti1 i ties , including electrical , telephone and ci television, shall be installed underground and/or shall bc completely concealed from view. 11. All public improvements shall be made in conformity \ subdivision ordinance and other City standards, to the sat of the City Engineer, without cost to the City of Carlsbac free of all liens and encumbrances. 12.
