HomeMy WebLinkAbout1973-10-09; Planning Commission; Resolution 971e-** c . 1 _1 /I @ e /I PLANNING COMMISSION RESOLUTION NO. 971 1 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, THE DEVELOPMENT OF A 12 UNrT CONDOMINIUM PROJECT ON PROPERTY GENERALLY LOCATED BETWEEN UNICORN10 STREET AND ALGA ROAD, EAST OF CORINTIA STREET IN LA COSTA, APPLICANT: ROBERT PARKER. APPROVAL OF A TENTATIVE MAPCCT 73-43) TO PERMIT 6 project on property generally located between Unicornio Street and Alga g subdivision map (CT 73-43) to allow the development of a 12 unit condomi 8 verified application from ROBERT PARKER requesting approval of a tentati 7 WHEREAS, the Planning Commission of the City of Carlsbad, did recei 10 east of Corintia Street in La Costa, more particularly described as: 11 12 Lot 427, La Costa Meadows Unit No. 3, per Map No. 7076 in the City of Carlsbad, County of San Diego, State of California. 13 and the STate of California Subdivision Map Act; and, 18 does substantially comply with the City of Carlsbad Subdivision Regulat' 17 WHEREAS, the Planning Commission did find that the subject tentati! 16 to have a non-significant impact on the environment; and, 15 of Carlsbad Environmental Protection Ordinance of 1972" and has been de( 14 WHEREAS, said application has complied with the requirements of the 19 WHEREAS, the Planning Commission is recommending Park-In-Lieu fees 20 the following reasons: 21 I 22 23 1. Carlsbad Municipal Code requires fees to be paid on subdivisions with less than 50 lots. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the C 24 25 26 the City of Carl sbad of the herein described Tentative Map (CT 73-43) , of Carlsbad, that it does hereby recommend approval to the City Council to the fulfillment of the following conditions: 27 28 29 30 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limita and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter may be in force for the purpose of preserving the residential characte of adjacent properties. ~ 31 11 32 - .- ,~ a* 0 e .. ., . .. 1 2 3 4 (2) 2. Park-in-lieu fees shall be paid to the City prio approval of the Final Map. 3. The Developer shall enter into a mutually accept agreement with the Escondido and Richmar Union School Districts to provide for future school requirements t will result from the proposed development. 5 6 7 4. In order to provide for reasonable fire protecti during the construction period, the subdivider shall passable vehicular access to all buildings, and adequ fire hydrants with required fire flows shall be insta as recommended by the Fire Department. 8 9 18 11 5. All public improvements shall be made in conform, to the City of Carlsbad Engineering Design Criteria ai Standard Plans, the Subdivision Ordinance and other C Standards, to the Satisfaction of the City Engineer, I out cost to the City of Carlsbad, and free of all lie1 encumbrances. Improvement plans for water and sewer : shall meet the requirements of the respective service 12 I 13 14 15 16 17 18 19 6. All drainage and grading plans shall be approved the City Engineer. 7. All utilities, including provisions for cable TW shall be placed underground and/or shall be completel: cealed from view. 8. No trenching shall be allowed in Unicornio Stree Alga Road. All utility connections shall be approved the City Engineer. 9. The developer shall create, and hereafter mainta- a Homeowner's Association for maintenance of landscap- drainage and recreation areas. I 20 21 22 10. The C.C.& R.'s for this development shall be SUI to the Planning Director for review and approval priol the issuance of any building permits. 11. A 6 foot high, solid, view-obscuring fence shall constructed and maintained along the westerly propert: ~ 23 required by the City Engineer. 24 12.
