I1 RESOLUTION NO. 973 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP (CT 73-48) TO PERMIT THE DEVELOPMENT OF A 62-UNIT CONDOMINIUM PROJECT, ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PIRINEOS I WAY, EAST OF VIEJO CASTILLA WAY, IN LA COSTA. ~ 6 WHEREAS, the Planning Commission of the City of Carlsba 7 development of a 62-unit condominium project, on property gc 9 approval of a Tentative Subdivision Map (CT 73-48) to permit 8 receive a verified application from SULLIVAN ENTERPRISES rec 10 located on the north side of Pirineos Way, east of Viejo Cas 11 Way, more particularly described as: 12 Map No. 6462 in the Office of the County Re- I 13 Lots 195, 196, 197 and 198 of La Costa South Unit No. 2, in the City of Carlsbad, as per 14 // corder of San Diego County, State of California. 15 of the “City of Carlsbad Environmental Protection Ordinance 16 WHEREAS, said application has complied with the require the environment, and; 18 1972” and has been declared to have a non-significant impact 17 19 WHEREAS, the Planning Commission did find that the subj 20 Map Act; and, 22 Subdivision Regulations and the State of California Subdivis 21 Tentative Map does substantially comply with the City of Car 23 WHEREAS, the Planning Commission is recommending Park-i 24 1. The development of the property described herein s be subject to the restrictions and limitations set fort which are in addition to all the requirements, limitati and restrictions of all municipal ordinances and State Federal statutes now in force, or which, hereafter, may in force for the prupose of preserving the residential characteristics of adjacent properties. 6 7 8 9 10 11 12 13 14 15 16 17 S8 19 20 21 2. Park-in-lieu fees shall be paid to the City prior approval of the Final Map. 3. The Developer shall enter into a mutually acceptab agreement with the Encinitas Union and San Dieguito Hig School District to provide for future school requiremen that will result from the proposed development. 4. In order to provide for reasonable fire protection the construc tion period, the subdivider shall maintain able vehicular access to all buildings, and adequate fi hydrants with required fire flows shall be installed as mended by the Fire Department. 5. All public improvements shall be made in conformit: the City of Carlsbad Engineering Design Criteria and St, Plans, the Subdivision Ordinance and other City Standarc to the Satisfaction of the City Engineer, without cost ' City of Carlsbad, and free of all liens and encumbrancer provement plans for water and sewer system shall meet tl requirements of the respective service districts. 6. All drainage and grading plans shall be approved b: City Engineer. 7. All utilities, including provisions for cable TV, : be placed underground and/or shall be completely concea' from view. 8. No trenching shall be allowed in Pirineos Way. All utility connections shall be approved by the City Enginc , ~ 22 9. The developer shall create, and hereafter maintain, 23 Homeowner's Association for maintenance of Landscaping, drainage and recreation areas. 24 25 I 10. The C.C.8. R.'s for this development shall be submii to the Planning Director for review and approval prior 1 the issuance of Final Occupancy.
