APPLICANT: R. 0. POWERS FEET TO 15 FEET (V-231) , ON PROPEPTY GENERALLY I 5 6 WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad Mur 7 in the minimum lot width from 60 feet to 15 feet (V-231) , on property ger 9 public hearing, to consider a request for a Variance, to permit the reduc 8 Code, the Planning Commission did on October 9, 1973 hold a duly noticed 10 located southerly of and adjacent to Chestnut Avenue, approximately 20 fc 11 easterly of the intersection of Eureka Place and Chestnut Avenue, further 12 described as: 13 14 15 Portion of Lots C and D of Alles Avocado Acres, Map No. 1855, in the City of Carlsbad, County of San Diego, State of California. WHEREAS, the subject application has: complied with the requirements 16 provision and general purpose of Title 21 of the Carlsbad Municipal Code: 21 to exist which make the granting of said Variance necessary to carry out 20 testimony and arguments, the Commission did find the following facts and 19 WHEREAS, at said public hearing, and upon hearing and considering i 18 have a "Non-Significant" impact on the environment; and, 17 of the Carlsbad Environmental Protection Ordinance and has been declared 22 23 24 25 26 27 28 1. The proposed split conforms to the requirements of the City's Panhandle Lot Policy. 2. The lots created conform to all other requirements of the Municipal Code. 3. Conformance of the density created to the recommendation: the Adopted General Plan. 4. The configuration of the existing lot results in a hardsl to the property owner which can only be resolved by the appli of the City's Panhandle Lot Policy. 29 32 31 Approval : 30 MHEREAS, said Variance is granted with the following Conditons of xx xx - - -.. The Variance is granted for the land described in the app and any attachments thereto, and as shown on the plot plan su mitted labeled Exhibit A. The location of all buildings, fen signs, roadways, parking areas, landscaping, and other facili or features shall be located substantially as shown on the pl plan 1 abeled Exhibit A, except or unless indicated otherwise herein. 2. Unless the use is inaugurated not 1 ater than one year aft1 the date the approval is granted and is di,ligently pursued th.ereafter, this approval will automatically become nul 1 and ' 3. Any minor change may be approved by the Planning Director Any substantial change will require the filing of an applicat for an amendment to be considered by the Planning Commission. 4. All requirements of any law, ordinance or regulation of t State of California, City of Carlsbad, and any other governme entity shall be complied with. 5. No signs or advertising of any type whatsoever shall be e or installed until plans therefore have been approved by the of Carl sbad. 6. All utilities, including electrical, telephone and cable television, shall be installed underground and/or shall be cot concealed from view. 9. All public improvements shall be made in conformity with 1 Subdivision Ordinance and other City Standards, to the satisfi of the City Engineer, without cost to the City of Carlsbad an( of all liens and encumbrances. 10. Prior to any construction, the applicant shall submit plt the appropriate entity providing domestic water to the propost velopment for its approval of the location , type and adequacy water lines, and to this Fire Department for approval of the . of fire hydrants. 11. Prior to the issuance of any permits, the applicant shal' dedicate a total of 12 feet of additional right of way for st1 purposes for the full frontage of the subject property along ( Avenue. 12. Prior to the issuance of any permits, a parcel map shall filed with the City of Carlsbad. 13.
