A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, GRANTING A VARIANCE TO PERMIT TEE REDUCTION IN THE MINIMUM LOT WIDTH FROM 60
LOCATED SOUTHERLY OF AND ADJACENT TO CHESTNUT AVEPKJE, UITH THE STREET ADDRESS OF 1049 CHESTNUT AVENUE. APPLICANT: R. 0. POWERS

6 WHEREAS, pursuant to the provisions of Title 21 of the Carlsbad Mur

in the minimum lot width from 60 feet to 15 feet (V-231) , on property ger 9
public hearing, to consider a request for a Variance, to permit the reduc 8

WHEREAS, the subject application has: complied with the requirements

provision and general purpose of Title 21 of the Carlsbad Municipal Code: 21
to exist which make the granting of said Variance necessary to carry out 20

1. The proposed split conforms to the requirements of the City's Panhandle Lot Policy.
2. The lots created conform to all other requirements of the Municipal Code.
3. Conformance of the density created to the recommendation: the Adopted General Plan.
4. The configuration of the existing lot results in a hardsl to the property owner which can only be resolved by the appli of the City's Panhandle Lot Policy.

1. The Variance is granted for the land described in the app and any attachments thereto, and as shown on the plot plan su mitted labeled Exhibit A. The location of all buildings, fen
signs, roadways, parking areas, landscaping, and other facili or features shall be located substantially as shown on the pl plan 1 abeled Exhibit A, except or unless indicated otherwise herein.
2. Unless the use is inaugurated not 1 ater than one year aft1 the date the approval is granted and is di,ligently pursued th.ereafter, this approval will automatically become nul 1 and '
3. Any minor change may be approved by the Planning Director Any substantial change will require the filing of an applicat for an amendment to be considered by the Planning Commission.

7. Compliance with and execution of all conditions 1 isted he] shall be necessary, unless otherwise specified, prior to obta. final building inspection clearance. Deviation from this reql ment shall be permitted only by written consent of the Plannil Director.
8. All utilities, including electrical, telephone and cable television, shall be installed underground and/or shall be cot concealed from view.
9. All public improvements shall be made in conformity with 1 Subdivision Ordinance and other City Standards, to the satisfi of the City Engineer, without cost to the City of Carlsbad an( of all liens and encumbrances.
10. Prior to any construction, the applicant shall submit plt the appropriate entity providing domestic water to the propost velopment for its approval of the location , type and adequacy water lines, and to this Fire Department for approval of the . of fire hydrants.
11. Prior to the issuance of any permits, the applicant shal' dedicate a total of 12 feet of additional right of way for st1 purposes for the full frontage of the subject property along ( Avenue.
12. Prior to the issuance of any permits, a parcel map shall filed with the City of Carlsbad.
13. Prior to the issuance of any permits, the applicant shall enter into a mutually acceptable agreement with the Carlsbad 1 School District to provide for future school requirements that result from the proposed development.
