HomeMy WebLinkAbout1973-11-13; Planning Commission; Resolution 988*- a zi I 2 3 4 5 0 0 PLANNING COMMISSION RESOLUTION NO ,988 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE UNITS ON 0.92 ACRES OF LAND, GENERALLY 1OCATED ON THE NORTH SIDE OF NAVARRA DRIVE BETWEEN VIEJO CASTILLA WAY AND APPLICANT: NATHAN SIMON MAP (CT 73-17) TO ALLOW THE DEVELOPMENT OF 12 CONDOMINIUM THE WESTERLY CUL-DE-SAC OF NAVARRA DRIVE. 6 acres of land generally located on the north side of Navarra Drive betw 9 Map (CT 73-17), to allow the development of 12 condominium units on 0.9: 8 a verified application from NATHAN SIMON, requesting approval of a Tenti 7 WHEREAS, the Planning Commission of the City of Carlsbad did rea 10 Viejo Castilla Way and the westerly cul-de-sac of Navarra Drive, and mol 11 particularly described as: 12 13 14 Lots 53 and 54 of La Costa South , Unit No. 1 , Map 611 7 , City of Carlsbad, County of San Diego, State of Californii WHEREAS, said application has complied with the requirements of . l5 declared to have a Non-Significant impact on the environment; and, I-t5 "City of Carlsbad Environmental Protection Ord jnanc.e of 1972", and has I 17 WHEREAS, the Planning Commissian did find that the subject tental l8 and the State of California Subdivision Map Act; and, l9 map does substantially comply with the City of Carlsbad Subdivision Reg1 20 WHEREAS, the Planning Commission does find that the provisions fc 21 the fol lowing reasons: 24 23 Plan of the City of Carl sbad; and, 22 design and improvements of this tentative map are consistent with the G( WHEREAS, the Planning Commission is recommending park-in-lieu fec 25 26 I 27 28 1. The Parks Ordinance requires fees for subdivisions wit1 than fifty (50) lots. 2. The adopted General Plan does not provide for a park s' at this location. Park-In-Lieu fees shall be granted to the City prior approval of the Final Map. 3. The C.C. &R's for this development shall be submittel to the Planning Director for review and approval prior t' issuance of any building permits. 4. In order to provide for reasonable fire protection d the construction period, the subdivider shall maintain p8 vehicular access to all buildings, and adequate fire hyd with required fire flows shall be fnstalled as recommend, by the Fire Department. 5. All pub1 ic improvements shall be made in conformity the City of Carlsbad Engineering Design Criteria and Sta Plans, the subdivision ordinance and other City standard to the satisfaction of the City Engineer, without cost ti the City of Carl sbad , and free of a1 1 1 iens and encumbra' Improvement plans for water and sewer system shall meet requirements of the respective service districts. 6. All utilities, including provisions for cable TV, shl placed underground and/or shall be completely concealed view. 7. Prior to consideration of this tentative map by the Council , the applicant shall submit written evidence to Planning Department from the applicable school district adequate facilities will exist for the proposed developm 8. All existing curb and gutter and sidewalks that do n conform to City Standards, shall be reconstructed in a m acceptable to the City Engineer. 9. The developer shall be required to participate in th construction of off-site traffic circulation improvement required by Council Policy in effect at the time of reco of the Final Map.
