A" P' .A i @ PLANNING COMMISSIOM RESOL 6 LON NO. 994 II 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A CONDOMINIUM COMPLEX, PROPERTY LOCATED GENERALLY AT THE NORTHEAST CORNER OF THE INTERSECTION OF LOWDER LANE (SCHUYLER RANCH ROAD) AND POINSETTIA LANE. APPLICANT: HESTER DEVELOPMENT COMPANY. TENTATIVE MAP (CT 73-23) TO ALLOW FOR A 190 UNIT 6 minium complex on property generally located at the northeast corner of 9 of a tentative subdivision map (CT 73-23) to allow for a 190 unit condo 8 a verified application from HESTER DEVELOPMENT COMPANY, requesting appr 7 WHEREAS, the Planning Commission of the City of Carlsbad did rece 10 more particularly described as: 11 intersection of Lowder Lane (Schuyler Ranch Road) and Poinsettia Lane, 12 13 14 Being a portion of the east half of the Northwest quarter of Section 28, T-12-S, R-4-W, S.B.B. & M. in the County of San Diego, State of California. 15 "City of Carl sbad Environmental Protection Ordinance of 1972", and 16 WHEREAS, said application has complied with the requirements of t 17 WHEREAS, the Planning Commission did find that the sub\ject Tentat 18 19 Map does substantially comply with the City of Carlsbad Subdivision Reg and the State of California Subdivision Map Act; and, 20 WHEREAS, the Planning Commission does find that the provisions fol 21 Plan of the City of Carl sbad, and; 22 design and improvements of this Tentative Map are consistent with the G( 1. The developer shall , at his expense, install a fully actua traffic signal, to City standards, at the intersection of Low Lane and Poinsettia Lane. A reimbursement agreement shall be completed between the developer and the City of Carlsbad to pe participation of future development adjacent to the intersecti in the cost of the traffic sianal. 3. The developer shall improve Poinsettia Lane on the basis o half street for 118 ft. right-of-way, fur the full frontage of subject property to City Standards. Full frontage shall inclu frontage along Lot 101. 4. The developer shall cause Camino de las Ondas to be improv the basis of a 34 ft. half street to City standards, for the frontage of the subject property, including lots 100 and 101. design of the intersection may require some minor widening to for left turns, in a manner acceptable to the City Engineer. 5. Occidental Petroleum shall dedicate Lagoon Lane extended, basis of a 30 ft. half street, for the full frontage of the su property from Poinsettia Lane to Camino de las Ondas extended. improvements of said lane shall be the requirements of the pro owner when the need for said road arises. 6. The improvement of the proposed private roadways, except fl widths, shall be installed to the City standards. The propose1 curbs and gutter is not approved. 7. The development of the property described herein shall be I to the restrictions and limi-tations set forth herein which are addition to all the requirements, limitations and restriction I all municipal ordinances and State and Federal statutes now in or which, hereafter, may be in force for the purpose of preser’ the residential characteristics of adjacent properties. 8. The C.C.&R’s for this development shall be submitted to th’ Planning Director for review and approval prior to the issuanc any building permits. 9. All public improvements shall be made in conformity to the( of Carlsbad Engineering Design Criteria and Standard Plans, tht Subdivision Ordinance and other City Standards, to the satisfac of the City Engineer, without cost to the City of Carlsbad, an( of all liens and encumbrances. Improvement plans for water an( sewer system shall meet the requirements of the respective ser! districts. 10. All drainage and grading plans shall be submitted to the ( Engineer for approval. 11. All utilities, including provisions for cable TV, shall bc underground and/or shall be completely concealed from view. 12. All land and/or easements required by this Ordinance sha’l’l granted to the City of Carlsbad without cost to the City and fr of a1 1 1 iens and encumbrances. 13. The subdivider shall dedicate to the pub1 ic, all rights o ingress and egress from lots abutting upon restricted access s and roads over and across the lines of said lots abutting said streets and roads. The standard condominium note shall be added to the tenta defining the project as a condominium.
