A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMpBNDING TO THE CITY COUNCIL,
DEVELOPMENT OF A 146 LOT SINGLE FAMILY SlJBDIYISION ON APPROXIMATELY 52.5 ACRES OF LAND, SAID LAND GENERALLY LOCATED EASTERLY OF AND ADJACENT TO EL CAMINO REAL, SOUTHERLY OF THE PRESENT SOUTHERLY MOST EXTENSION OF TRIESTE DRIVE.

WHEREAS, said application has complied with the requirements of the

E.I.R. has previously been accepted by the Planning Commission and City COL 17
"City of Carlsbad Environmental Protection Ordinance of 1972", and the Fin;
and the State of California Subdivision Map Act; and, 20

1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and;F@deral statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties.
2. Park-in-lieu fees shall be granted to the City prior to appl of the Final Map.
3. Prior to consideration of this request by the City Council , written evidence of compliance to the City Council school polic: shall be submitted to the Planning Department.
4. In order to provide for reasonable fire protection during tl constructim period, the subdivider shall maintain passable veh, access to all buildings, and adequate fire hydrants with requirc fire flows shall be installed as recommended by the Fire Departn
5. All public improvements shall be made in conformity to the I

7. Ornamental street lighting shall be in harmony with the His] motif along El Camino Real and shall be provided for as require( by 'fjunicipal Ordinance Code. The Developer shall post a bond it amount necessary to energize said street lights for an eighteen month period after construction to permit the incorporation of . subdivision into a maintenance district.

The Subdivider shall dedicate to the public all rights of il and egress from lots abutting upon restricted access streets an( roads over and across the lines of said lots abutting said stre! and roads. This dedication shall be so designated on the certi, sheet of the Final Map with the intent that the owners of said ' will have no rights of access whatsoever to said streets and roz The words "access rights dedicated to the City" shall be letterc along the road adjacent to the lots affected on the map proper. Camino Real and Tamarack Avenue shall be considered limited accz roadways in this instance.
9. Street names shall be subject to approval and shall be desi! in accordance with the standards and policies adopted by the P' Commission on file in the Planning Department. Said names shal' approved by the Planning Director prior to recordation of the F. Map.

Dedication and improvement of El Camino Real shall be requ' on the basis of a 63 ft. half street from the existing center 1' The improvement of El Camino Real shall include the standard st1 improvements, Mission Bel 1 street 1 ights, and any required im- provement of the existing drainage ditch. Said improvements shi be in a manner acceptable to the City Engineer.

11. The developer shall grant to the City of Carlsbad an open
space easement over the existing slope located adjacent to El Camino Real . As a part of the development , said slope shall be 1 andscaped in a manner acceptable to the Director of Parks and Recreation.
12. The applicant shall install a water line from the existing Kelly vault to the southeast corner of the proposed subdivision. The a1 ignment and ultimate size of said 1 ine shall be as approve by the City Engineer.
13. The applicant shall construct a sewer line from Kelly Drive to the southeast corner of the subject property. The alignment and ultimate size of said line shall be as approved by the City Engineer.
14. The applicant shall participate in the installation and cos
of a traffic signal at the proposed interseciton of El Camino Re. and Tamarack Avenue in a manner acceptable to the Ctty Engineer.
