A RESOLUTION OF THE PLANMING COMMISSION OF TiiE CITY OF CARLSBAD, CALIFORNIA, GRANTING A COMilITIONAL US€ PERMIT TO ALLOU THE ENLARGEMENT OF THE EXISTING CINEMA PLAZA FROM ONE TO FOUR VIEWING THEATRES, ON PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF EL CAMINO REAL AND MARRGN ROAD. APPLICANT: SIEGEL BROTHERS INVESTMENT COiviPANY
NHEREAS, pursuant to the provisions of Ordinance No. 9060,

duly noticed public hearing to consider the application of SIEE
BROTHERS INVESTIL4ENT CO. for a Conditional Use Permit for the pti
pose of allowing the enlargement of the existing Cinema Plaza f
one to four viewir.g theatres, on property generally located ai
s.outhuest corner of the intersection of El Csmino Real and i'4aru
Road, and more particularly descrfbed as:
Portion N.M. 1/4 Section 32, Township 11 South, Range 4 Irdest, S.B.ivl. per Psomas 8 Young Survey dated December 5, 1968.
MHEREAS, the subject application has complied with the re-
quirements of the "City of Car-lsbad Environmental Protection
Ordinance of 1972", and has been declared to have a ~on-~ignif-
cant impact on the environment, and;
MHEREAS, at said public hearing on February 26, 1974, up02

ion did f?nd the following facts and reasons to exist which mal
the granting of a Conditional Use Permit necessary to carry Ou;
the provisions and general purpose of Ordinance No. 9060:

MHEREAS, Pursuant to General Plan standards, tile existing
692,000 sq. ft. development within the El Camino Plaza, would
require a total sf 1730 parking spaces. A total of 3300 parki
spaces now exists, which would indicate that sufficient parkin
does exis,t to meet the required parking of 238 spaces for the
proposed expansion of the existing theatre.
NOM, THEREFORE, BE IT RESOLVED by the Planning Commission
the City of Carlsbaa, that it does hereby grant a Conditional
Use Permit on said property, subject to the fulfillment of the
following conditions:
1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A.

Unless the construction of the structure or facility is commenced not later than one year after the date the approval is granted and is diligently pursued thereafter, this approval will automatically become null and void.
Any mi nor change nay be approved by tne Planning Director. Any substantial change will require the filing of an application for an amendment to Le con- sidered by the Planning Commission.,
All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with.
No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad.
All areas shown as parking areas shall be surfaced with asphaltic concrete and shall be visibly marked outlining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or struc- tures by the Building Department. The surface shall be kept in a reasonably good state of repair at all times.
Prior to obtaining a building permit and within 30 days hereof, the applicant shall file with the Secretary of the Planning Commission written acceptan1 of the conditions stated herein.
Any mechanical and/or electrical equipment to be located on the roof of the structure shall be screenel in a manner acceptable to the Planning Director. De- tailed plans for said screening shall be submitted, i] triplicate, to the Planning Director.

9. All lighting shall be arranged to reflect away from adjacent property and streets.
10. All outside storage areas shall be screened from adjacent property and streets.
11. Interior landscaping of parking areas shall be pro- vided in a manner acceptable to the Planning Directo Said minimum area of landscaping shall be equivalent to 3% of the area of the lot excluding required perimeter landscaping.
12. A detailed lanascape and sprinkler plan prepared by a landscape architect, shall be submitted to the Planning Director for consideration and approval.
13.- Prior to final building inspection clearance, all landscaping shall be installed. Said landscaping shall, at all times, be maintained in a manner acceptabls to the Planning Director.
14.. All landscape areas in parking lots shall be enclosc by a raised concrete curb or low wall. All planters adjacent to street right-of-way shall be constructec with weep holes per specifications of the City Engir
15. All utilities to any structure approved herein shall be supplied by underground feed.
16. All public improvements shall be made in conformity with the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer uithout cost to the City of Carlsbad and free of all 7 iens and encumbrances e
17. Prior to final occupancy, compliance bJith and execution of all conditions listed hereon shall be necessary, unless otherwise specified. Deviation from this requirement shall be permitted only by written consent of the Planning Director.
18. Prior to any occupancy or the issuance of arry Occupi clearance for the structure, said existing structure shall be inspected by the Building Dept. for coilplii to the requirements of the applicable edition of thi Uni form Bui 1 ding Code.
19. That the architecture of the proposed expansion sha be compatible to the existing building.
20. That no signs shall be considered approved as a par of this actjon.
21. Prior to the issuance of any permits, the applicant obtain approval from the City sf Carlsbad Parking A ity for the proposed joing usage of parking within shopping center, as well as approval of Traffic Safl Cornmitttee to include additional Sighting and crossw8
