CASE NO. CUP-94 CARLSBAD LIONS CLUB MHEREAS, pursuant to the provision of Title 21 of the Carlsbad Municipal Code, the Planning Commission did on the 9t April, 1974, hold a duly noticed Public Hearing for a Conditio Use Permit to allow the establishment of a five-day carnival o property located in the R-1-75 zone and more particularly des- cri bed as: A 2.63 acre portion of Map #1681 recorded with the San Diego County Recorder, portion of Thurn Lands Tract No. 250-R 03G482, PM 558 WHEREAS, the subject application has complied with the requirements of the "City of Carlsbad Environmental Protectior Ordinance of 1972", in that the proposed carnival is consider6 exempt. WHEREAS, at said Public Hearing on the Conditional Use Permit request, upon hearing and considering all testimony ant arguments, the Planning Commission did find that the followin! facts and reasons to exist which make the Denial of a Condi- tional Use Permit necessary to carry out the provisions and general purpose of Title 21 of the Carlsbad Municipal Code: (1) That the requested use is not necessary or desirable for the development of the community, is not essentially in harmony with the various elements and objectives of the Gener Plan, and is detrimental to existing uses or to uses specific permitted in the zone in which the proposed use is to be loca (2) That the site for the intended use is not adequate i size and shape to accommodate the use; (3) That all of the yards, setbacks, walls, fences, land scaping, an6 other features necessary to adjust the requested tw * L .. v a a 2 3 4 5 6 7 8 9 10 11 32 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 11 to existing or permitted future uses in the neighborhood would not be provided and maintained; (4) That the street system serving the proposed use is not adequate to properly handle all traffic generated by- the proposed use. NOW, THEREFORE, BE IT RESOLVED by the Planning Commissi of the City of Carlsbad as follows: (1) That the above re- citations are true and correct, (2) that it does hereby deny A Conditional Use Permit on said property. PASSED, APPROVED AND ADOPTED at a regular meeting of th Carlsbad City Planning Commission on April 9, 1974 by the foll vote, to wit: AYES: Commissioners Casler, Little, Jose, & Wrench NOES: None ABSENT: Forman & Dominguez ABSTAIN: Barrett i. .. . >A .'A //,<; i !Aced-.-.
