A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, AF!?IOUNCIFIG FINDINGS AND RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF AN AMENDMENT TO CITY COUNCIL ORDINANCE NO. 9302, SPECIFIC PLAN
NO. 22, FOR PROPERTY GENERALLY LOCATED AT TA,,R!ARACK AVENUE APlD JEFFERSON STREET. APPLICANT: PACIFICA WESTERN DEVELOPMENT CORPORATI091
InlHEREAS, a duly advertised public hearing was held on April 23, 1974
before the Planning Commission of the City of Carlsbad, to consider adopti
of an Amended Specific Plan No. 22, to allow for the development of a 50
unit condominium complex (in lieu of original Specific Plan dated May 2,
1972 call ing for 60 units) , on property generally located at the northwest
corner of the intersection of Tamarack Avenue and Jefferson Street and
more particularly described as:
That portion of tract 231 of Thum Lands, in the City of Carlsbad, California, according to Map thereof No. 1681, filed in the office of the County Iiecorder of San Diego County, Dec - 9, 1915-
WHEREAS, said application has met the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1972 and has been declared
to have a Non-Significant impact on the environment; and,
WHEREAS, at said public hearings, upon hearing and considerina the
testimony and arguments, if any, of a1 1 persons who desired to be heard,
said Commission did find the following facts and reasons to exist which ma
the granting of an application for adoption Of an mendment to a SPecifi
Plan (sp-22) necessary to carry out the provisions and general purpose of
Title 21 of the Carl sbad Municipal Code:
I. The amended Specific Dlan, marked Exhibit ”B”, is a substantial improvement over the original design in terms of compatibility to existing and proposed uses in the area.
2. The Amended Specific Plan provides greater open space and
recreational amenities for potential occupants.
F10!1, THEREFORE, BE IT RESOLVEG by the Planning Commission of the
City of Carlsbad, that it does recommend to the Cit!! Council, adoption
of an amended specific plan (City Council Ordinance 9302), on said propert,
according to the following conditions and limitations:
GENERAL CONDITIONS:

A. The development of the propertv described in Section 1 hereof sh,
be subject to the restrictions and limitations set forth herein whic are in addition to all the requirements, limitations and restriction

I of all municipal ordinances and State and Federal statutes now in forc e, or which hereafter may be in force for the purpose of preserv the residential characteristics of adjacent properties.
B. All public improvements shall be made in conformity with the Subdivision Ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free o all liens and encumbrances.
C. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances.
PRIVATE DEVELOPMENT CONDITIONS: The following conditions shall apply with respect to the development of said Specific Plan:
A. That a maximum of 50 units be develoned a.s shown on SDecific Plar Exhibit 'IB" i
B. Tha.t the applicant must comply with the City of Carlsbad Parks or Fee in Lieu of Dedication, and City of Carlsbad Ordinance No. 919(
C. The proposed handball courts indicated on Exhibit B, will be rep-

D. That all parking facilities shall be functional and within easy access to their respective units. Revision shall be subject to apprc
of the Planning Director.
E. That a landscape and sprinkler plan shall be submitted to the Pal and Recreation Director for approval. ..
F. That the design of the facility (building and parking)shall be subject to Planning Department approval.
G. That a block wall shall be constructed along the northerly prope line adjoining the Jefferson Street School site.
H. That satisfactory emergency access or fire hydrants to portions the development shall be approved by the City of Carlsbad Fire Depar
I. That the type and location of fire hydrants for the development shall be approved by the City Engineer.
J. The appl icant shall file a parcel map in accordance with the Sta Map Act.
I(. Necessary right-of-way on Tamarack Avenue (34') shall be dedicat to the City of Carlsbad for street widening purposes.
L. Full street improvements to the center line shall be constructed
in accordance with the City of Carlsbad subdivision ordinance or as modified by City Council policy including ornamental street lights, which shall be subject to the approval of the City Engineer.
M. All utilities, including relocation of existing utilities, shall Placed underground.
N. Mater shall be provided by the City of Carlsbad.

0. The applicant shall install an 8" KP sewer along the Tamarack frontage of the property parallel to the existing 6' line or deposit funds with the City of Carlsbad to upgrade the line at a future date.
P. Ingress and egress to the development shall be limited to one point on Jefferson and one point on Tamarack .\venue.
AND FINALLY BE IT RESOLVED that a copy of this Resolution be forwarde
6 to the City Council for its attention in the manner prescribed by law.
