RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE CONDITIONAL
USE PERMIT TO ALLOW THE ESTABLISHMENT OF A MOBILE
HOME AS A TEMPORARY BANK FACILITY ON PROPERTY LOCATED EASTERLY OF PJ!D ADJACENT TO EL CAMINO REAL NORTHERLY OF THE INTERSECTION OF MARRON ROAD AND EL CAMINO REAL,
SAVINGS AND LOAN ASSOCIATION OF SAN DIEGO ZONED C-2. CASE 1\10. CUP-95, APPLICANT: HOME FEDERAL

WHEREAS, a verified application for a certain property, to wit:
Those portions of Lots 4 and 5 of Fractional Section 32, Town- ship 11 South, Range 4 West, San Bernardino Meridian in the
City of Carlsbad, County of San Diego, State of California,
according to United States Government Survey approved
December 27, 1870;
has been filed with the City of Carlsbad and referred to the Planning
Comnlission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on April 23, 1974; and
WHEREAS, the applicant has complied with the Public Facility Policy c
City of Carlsbad and has provided the necessary information which insures
Plublic Facilities will be available and current with need; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, 5
Commission considered all factors relating to the Conditional Use Permit :
found the following facts and reasons to exist:
1. The requested use is necessary or desirable for the development the community, is essentially in harmony with the various elemer
and objectives of the General Plan, and is not detrimental to e) uses or to uses specifically permitted in the zone in which the proposed use is to be located;
2. The site for the intended use is adequate in size and shape to
accommodate the use;
3. A1 7 of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained;
4. The street system serving the proposed use is adequate to proper handle all traffic generated by the proposed use.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That a Conditional Use Permit is approved to allow the establish1 of a mobile home as a temporary bank facility on property locate'
easterly of and adjacent to El Camino Real northerly of the inte section of Marron Road and El Camino Real, zoned C-2, and is sub,
to the following conditions:
1. Prior to issuance of any permits, all requirements of City Counci 1 Resolution No. 3304 necessary to .permit the propose temporary facility shall be completed in a manner acceptabl the Planning Director and City Engineer.
2. The approval is granted for the land described in the appli
tion and any attachments thereto, and as shown on the plot submitted labeled Exhibit A. The location of all buildings fences, signs,roadways, parking areas, landscaping and othe facilities or features shall be located substantially as sf- on the plot plan labeled Exhibit A, except or unless indica otherwise herein.

Prior to final building inspection clearance, all landscapi
shall be installed. Said landscaping shall, at all times, maintained in a manner acceptable to the Planning Director.
All utilities including electrical, telephone and cable
television, shall be installed underground and/or shall be
pletely concealed from view.
All public improvements shall be made in conformi ty with th
division Ordinance and other City Standards, to the satisfa
of the City Engineer, without cost to the City of Carlsbad
free of all liens and encumbrances.
Prior to any construction, the applicant shall submit plans the appropriate entity providing domestic water to the prop
development, for its approval of the location, type and ade
of water lines, and to this Fire Department for approval of
location of fire hydrants.
Prior to final occupancy, compliance with and execution of
conditions listed hereon shall be necessary, unless otherwi
specified. Deviation from this requirement shall be permit
only by written consent of the Planning Director.
This Conditional Use Permit is granted for a one year peric
time ending April 23, 1975.
The Conditional Use Permit shall expire when the use for wi
it is granted is discontinued for a period of 30 consecuti\ days or more.
This approval is granted to the applicant only, and is not
assignable to others.
Wherever in the opinion of the Planning Director it is appl

Planning Commission held on April 23, 1974 by the following vote, to wit:
