A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL, THE APPROVAL OF A TENTATIVE MAP
FAMILY SUBDIVISION LOCATED ON PARK DRIVE BETWEEN ADAMS STREET AND HILLSIDE DRIVE. APPLICANT: KAMAR CONSTRUCTION COMPANY CT 74-6
(CT-74-6) TO ALLOW DEVELOPMENT OF A 10-LOT SINGLE-
WHEREAS, the Planning Commission did on the 14th day of
May, receive a verified application from KAMAR CONSTRUCTION
COMPANY, requesting approval of a tentative subdivision map
CT 74-6 to allow a 10-lot single-family subdivision, 10,000
square foot lots minimum in the R-1-10 zone district, on prop
generally located on Park Drive between Adams Street and Hill
Drive. Said property is further described as:
Parcel 1: Lots 1 and 2 in Block 'IF" of Bellavista, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 2152, f filed in the office of the County Recorder of San Diego County, March 7, 1929.
WHEREAS, said application has complied with the require
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been determined to have an insigni
ficant impact on the environment; and,
WHEREAS, the Planning Commission did find that the subj
tentative map does substantially comply with the City of
Carlsbad Subdivision Regulations and the State of California
Subdivision Map Act; and,
WHEREAS, the Planning Commission is recommending Park-:
Lieu fees rather than the dedication of park land, for the
following reasons:
1. Conformance of the Tentative Map to all requirement of the Municipal Code and the State of California Subdivision Map Act.
2. Conformance of the Map to the present General Plan Land Use commitment of low-density residential with with 2-7 dwelling units per acre and to the propose Land Use Element Revision (pending) of low medium density residential with 0-4 dwelling units per acr The proposed density is 3.5 d.u/acre.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commissior
of the City of Carlsbad, that it does hereby recommend
approval to the City Council of the City of Carlsbad, the
herein described Tentative Map (CT 74-6) subject to the ful-
fillment of the following conditions:
1. The development of the property described herein shal be subject to the restrictions and limitations set fortk herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinance: and State and Federal statutes now in force, or which, here-after, may be in force for the purpose of preservin! the residential characteristics of adjacent properties.
2. Park-In-Lieu fees shall be granted to the City prior City Council approval of the Final Map.
3. In order to provide for reasonable fire protection dt the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate - hydrants with required fire hydrants with required fire . shall be installed as recommended by the Fire Department
4. All public improvements shall be made in conformity : the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, wit1 out cost to the City of Carlsbad, and free of all liens i encumbrances. Improvement plans for water and sewer sys' shall meet the requirements of the respective service districts.
5. Street lighting shall be provided for as required by Municipal Ordinance Code. The Developer.shal1 post a bond and/or cash in the amount necessary to energize sail street lights for an eighteen month period after con- struction, to permit the incorporation of the subdivisio' into a maintenance district.
6. The Subdivider shall dedicate to the public all righ of ingress and egress from lots abutting upon restricted access streets and roads. This dedication shall be so designated on the certificate sheet of the Final Map wit the intent that the owners of said lots will have no rig of access whatsoever to said streets and roads. The wor "access rights dedicated to the City" shall be lettered along the road adjacent to the lots affected on the map proper, shall apply to Park Drive.
7. Street names shall be subject to approval and shall designated in accordance with the standards and policies adopted by the Planning Commission on files in the Plann Department. Said names shall be approved by the Plannin Fire and Police Departments prior to recordation of the. Final Map.
8. Park Drive shall be dedicated and improved to City Standards for the full frontage of the subject property on the basis of 42 ft. half street width.
