HomeMy WebLinkAbout1974-06-25; Planning Commission; Resolution 1073.I -A I1 PLAWNG COMMISSION RESOLUTION . 1073 0 1 2 3 4 5 6 7 8 9 10’ 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE SUBDIVISION MAP TO ALLOW A 21 LOT SUBDIVISION ON PROPERTY’ LOCATED EAST OF LOWDER LANE BETWEEN PALOMAR AIRPORT ROAD AND POINSETTIA LANE. APPLICANT: PACESETTER HOMES, INC. CASE NO. CT 73-59 WHEREAS, the Planning Commission did on the date of June 1974, hold a duly noticed Public Hearing to consider a request Pacesetter Homes, Inc. for a Tentative Map, identified as EXHI A, revised June 27, 1974 and attached hereto, to allow a 21 lo subdivision on a 59.42 acre site zoned P-C (Planned Community) generally located east of Lowder Lane between Palomar Airport and Poinsettia Lane and more particularly described as: A portion of the West half of Section 21, Township 21 South, Range 4 West, S.B.B.M., in the City of Carlsbad, further described on fa’le in the Carlsbad Planning Department; UHEREAS, the applicant submitted an Environmental Impact Report which met the requirements of the “Carlsbad Environmentl Protection Ordinance of 1972” and was accepted by the City Cou as a part of City Council Resolution 3302, dated January 2, 19 WHEREAS, at said public hearing, upon hearing and conside the testimony and arguments, if any of all persons who desired be heard, said Commission did find the following facts and rea to exist which make the approval of this Tentative Map, identi as EXHIBIT A, revised June 21, 1974 and attached hereto, neces to carry out the provisions and general purpose of Title 27: (1) Conformance to the Subdivision Map Act. (2) Compliance with local statutes and General Plan. WOW, THEREFORE, BE IT RESOLVED that the Planning Commissic of the City of Carlsbad, California, does hereby recommend to i Cjty Council adoption of Tentative Map No. CT 73-59, identifiec EXHIBIT A, revised June 21 , 1974 and attached hereto, subject . the following conditions: .. (9) The development of the property described herein sha be subject to the restrictions and limitations set forth herein which are in addition to all the requir ments, limitations and restrictions of all municipal ordinances and State and Federal statutes now in for or which, hereafter, may be in force for the purpose preserving the residential characteristics of adjace properties. (10) The C.C. & R.'s for this development shall be submit to the Planning Director for review and approval pri to the issuance of any building permits. (11) In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings adequate fire hydrants with required fire flows shal be installed as recommended by the Fire Department. (12) All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and ot City Standards, to the satisfacti.en of the City Engi without cost to the City of Carlsbad, and free of a1 liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. (13) Street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall PO a bond and/or cash in the amount necessary to energi said street lights for an eighteen month period afte construction, to permit the incorporation of the sub division into a maintenance district. _, .,_ y e 0 1 2 3 (14) All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cos to th.e City, and free of all liens and encumbrances.
