CASE NO: CT 74-9 APPLICANT: JOHN CREHAN i5 II 7 WHEREAS, a verified application from John Crehan requesti! 8 dated June 3, 1974, attached hereto, to allow development of a 9 approval of a Tentative Map (CT 74-9) identified as Exhibit A, 10 and further described as: 32 northwest intersection of Chestnut Avenue and AT&SFRR Right-of. 11 16 Unit Condominium project on a .92 acre site located at the 33 14 15 36 17 That portion of Tract 225 and 30-foot strip northeasterly of Thum Lands, in the City of Carlsbad, County of San Diego, State of California, according to Map 1681 filed in the office of the County Recorder of San Diego County December 9, 1915, and more particularly described on file in the City of Carlsbad Planning Department. WHEREAS, said application has complied with the kequiremer 18 the. environment for the following reason: 20 1972" and has been determined to have an insignificant impact ( 19 of the "City of Carlsbad Environmental Protection Ordinance of 21 22 23 (1) The project is relatively small in an existing, graded "R-3" area. WHEREAS, the applicant has cornplied with the Public Facili 24 current with need; and 26' information which insures Public Facilities will be available i 25 Policy of the City of Carlsbad and has provided the necessary 27 WHEREAS, the Planning Commission did take into considerat' 28 Regulations and the State of California Subdivision Map Act; ar 32 Tentative Map does comply with the City of Carlsbad Subdivisioa 31 NHEREAS, the Planning Commission did find that the subject 30 reviewing agencies; and 29 the Tentative Map as submitted and the reports of the various L 'L II 0 e . :I 1 MHEREAS, the Planning Commission did. find that the subjec 2 Tentative Map does comply with. th.e adopted General Plan; and 3 WHEREAS, the Planning Commission is recommending Park-in- 4 (1)There are less than 50 units proposed for this project 6 reason: 5 fees rather than the dedication of Park Land, for the followin 7 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission 8 the City of Carlsbad as follows: 9 10 11 32 13 14 15 3.6 17 18 19 (1) That the above recitations are true and correct and constitute the findings of the Commission in this ca (2) That it does hereby recommend approval to the City Council of the City of Carlsbad of the above describ, Tentative Map No.CT 74-9, subject to the following conditions: a) The development of the property described hereir shall be subject to the restrictions and limita; set forth herein which are in addition to all tl requirements, limitations and restrictions of a' municipal ordinances and State and Federal stat1 now in force, or which, hereafter, may be in fol for the purpose of preserving the residential characteristics of adjacent properties. b) The C.C. & R's for this development shall be submitted to the Planning Director for review a1 approval prior to the issuance of any building permits. 20 21 22 23 24 25 2 6, 27 2% 29 30 33. 32 c) Park-in-lieu fees shall be granted to the City prior to City Council approval of the final map. d) In order to provide for reasonable fire protecti during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with requiv fire flows shall be installed as recommended by the Fire Department. e) All public improvements shall be made in conforn to the City of Carlsbad Engineering Design Critc and Standard Plans, the Subdivision Ordinance ar other City Standards, to the satisfaction of thc City Engineer, without cost to the City of Carl! and free of all liens and encumbrances. Improve ment plans for water and sewer systems shall mee the requirements of the respective service distr f) Ornamental street lighting shall be provided for as required by Municipal Ordinance Code.
