A RESOLUTION OF THE PLANNIMG COMMISSION OF THE
CITY OF CARLSBA9, CALIFORNIA, GRANTING A VARIANCE FROM SECTION 21.16.030 OF THE CARLSBAD MUNICIPAL CODE TO ALLOW A REDUCTION IN THE FRONT YARD SET- BACK REOUIREMENT FOR THE R-3 ZONE ON PROPERTY GENERALLY LOCATED AT 2731' OCEAN STREET, CARLSBAD, CALIFORNIA. 8 WHEREAS, pursuant to the provisions of the Municipal Code, the Plannil

B. Because of said special circumstances the property may not bt
utilized in the same manner as the other similarly zoned pro[
in the area as such variance is necessary for the preservatic enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied tc property in question because it is much older and the garage built to accomodate smaller automobiles.
C. The variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the subject ProDerty is located bt

PASSED, APPROVED AND ADOPTED at a regular meeting held on the 10th day
September, 1974 by the Carlsbad Planning Commission, by the following vote,
