REQUEST FOR AMENDMEWT TO CITY COUNCIL RESOLUTION CASE NO. SP-109, APPLICANT: SYSTEMS CAPITAL 5 11 6l 7l WHEREAS, a verified application for a certain propert.y, to wit: All that portion of Lot "G" of Rancho Aqua Hedionda in the County of San Dieao, State of California, according 8 to Map thereof No. 823 filed in the Office of the County 9 ll Recorder of said County; 10 11 has been filed with the Cit~y of Carlsbad and referred to the Planning Commission; and -12 14HEREAS, said verified application constitutes a request as provided f3 14 Title 21 of the "Carlsbad Municipal Code"; and 15 MHEREAS, the public hearing was held at the time and in the place 1 specified in said notice on September 24, 1974; and 16 WHEREAS, the applicant has complied with the Public Facility Policy ( 17 the City of Carlsbad and has provided the necessary information which insL 18 Public Facilities will be available and current with need; and 19 WHEREAS, the subject application has complied with the requirements c 20 the City of Carlsbad "Environmental Protection Ordinance of 1972"; and 23. The initial requirement was to provide a signalized access to pl to the west, which will now be met by the Cabot, Cabot and Forb( subdivision through the street from El Camino Real to Palornar Ai port Road. 2. The cul-de-sac Street "C" will provide access to the rear portic of the Hughes property. 3. The property owners (Huahes and Cabot, Cabot and Forbes) have PIE with the City and are agreeable to the modification. 4. Development conditions 81 and 82 to be deleted read as follows, 1. The applicant shall participate in the installation of a fully actuated traffic signal at El Camino Real for the proposed 40 fc driveway along the southerly property line. Such participation shall be based on the proportionate share of the warrant traffic defined in Section 9 of the California State Division of Hiahwa: traffic manual) on the southerly road, generated by the agpl ical Appl icant shall be reimbursed for the additional proportionate I of traffic generated by future development bordering the southel street as may be authorized by law. 2. The 4.0 foot driveway shall ultimately be built to City street standards and the southerly 50 feet of the property shall be off for dedication to the City by the developer.
