PLANNING COMMISSION RESOLUTION NO. 1097
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE MAP TO ALLOW THE DEVELOPMENT OF A 232 LOT SUB- DIVISION ON A 75 ACRE PARCEL OF LAND ZONED RD-M, LOCATED ON THE SOUTH SIDE OF CAMINO DE LAS ONDAS
STANDARD PACIFIC OF SAN DIEGO
AND EAST OF LAGOON LANE. CASE NO. 74-16, APPLICANT:

WHEREAS, a verified application for a certain property, to wit:
The westerly 1/2 of the northeasterly 1/4 sec. 28, T 12.S R4W, SBB & My excepting the northerly 871 feet of the westerly 150 feet and also excepting therefrom any portion
of Spinnaker Hills, CT 73-39;

has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy
the City of Carlsbad and has provided the necessary information which ins
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Tent
Map and found the following facts and reasons to exist:
1. The requested use conforms to the Subdivision Map Act.
2. The requested use complies to the General Plan and applicable Municipal Code requirements.
3. The requested use complies with requirements of the Carlsbad
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cil
Carlsbad, California, as follows: That a Tentative Map is approved for 1
said property to allow the development of a 232 lot subdivision on a 75 E
parcel of land zoned RD-M, located on the south side of Camino de las On(
and east of Lagoon Lane, and subject to the following conditions:
Zone Ordinance.
1. The Final Map shall be submitted for approval within one year 1 the final action by the City Council on the Tentative Subdivis. Map. The Final Map shall be in substantial conformance of the

2. The development of the property described herein shall be subje the restrictions and limitations set forth herein which are in addition to all the requirements , limitations and restrictions all municipal ordinance and State and Federal statutes now in f or which, hereafter, may be in force for the purpose of preserb the residential characteristics of adjacent properties.
3. A1 1 public improvements shall be made in conformity to the Citj Carlsbad Engineering Design Criteria and Standard Plans, the SL division Ordinance and other City Standards, to the satisfactic the City Engineer, without cost to the City of Carlsbad, and fr all liens and encumbrances. Improvement plans for water and se systems shall meet the requirements of the respective service districts.
4. All land and/or easements required by this Ordinance shall be g to the City of Carlsbad without cost to the City and free of a1 1 iens and encumbrances. No easements shall be recorded prior t recordation of the Final Map unless approved by the City Engine
5. All utilities, including provisions for cable TV, shall be plac underground and/or shall be completely concealed from view. Th shall be noted on the Final Map.
6. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond and/ cash in the amount necessary to energize said street lights for eighteen month period after construction to permit the incorpor of the subdivision into a maintenance district. This shall be 1 prior to approval of Final Map.
7. The improvement plans shall include a report of a geological in' gation and a complete grading plan of the entire site when requ by the City Engineer. The report and plan shall be prepared by
Civil Engineers licensed by the State of California, and experi in erosion control. Said Engineer shall certify that they have investigated the site and prepared data with full consideration the consequences to the included and neighboring properties and conform to the standards of the Geological Safety Element of th General P1 an.
8. All slopes created as a result of this development shall not ex a 2:l slope. This condition shall be noted on Final Map.
9. Ingress and egress along the property line bordering public str right of way for all lots shall be dedicated, except at locatio as specified by the City Engineer. Dedication shall be made pr to approval of Final Map.
10. In order to provide for reasonable fire protection during the c( struction period, the subdivider shall maintain passable vehicu' access to all buildings and adequate fire hydrants with require( fire flows and dry-stand pipes shall be installed prior to fram. construction. This condition should be noted on the Final Map.
11. Park-In-Lieu Fees shall be granted to the City prior to City Cot approval of the Final Map.
12. The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the approval of the Final Map.
