I PLANNING COMMISSION RESOLUTION NO. 1098
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, COFJCERNING THE TENTATIVE
MAP, CONSISTING OF ONE LOT, TO PERMIT THE DEVELOP-
MENT, OF 20 CONDOMINIUM UNITS IN A R-3 ZONE DISTRICT LOCATED ON THE WEST SIDE OF HARRISON STREET, .APPROXI-
NO. CT 74-20, APPLICANT: HARRISON LAGOON
MATELY 250 FEET SOUTH OF CHINQUAPIN AVENUE. CASE
WHEREAS, a verified application for a certain property, to wit:
Parcel 1 in the City of Carlsbad, County of San' Diego, State
of California, as shown on page 2484 of Parcel Maps,. filed
in the office of the County Recorder of San Diego County;
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; .. .and
WHEREAS, the applicant has complied with the Public Facility Policy of
the City of Carlsbad and has provided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Tentative
Map and found the following facts and reasons to exist:
1. The requested use conforms to the adopted General Plan.
2. The requested use complies to all City Ordinances and Policies.
3. The requested use complies with the Subdivision Map Act.
NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the City of
Carlsbad, California, as. follows: That a Tentative Map is approved for use
of said property to allow the development of 20 condominium units in a R-3
Zone District located on the west side of Harrison Street, approximately 250
feet south of Chinquapin Avenue, and subject to the following conditions:
1. All public improvements shall be made in conformity with the Sub- division Ordinance, and other City standards, to the satisfaction
of the City Engineer, without cost to the City of Carlsbad, and
free of all liens and encumbrances.
2. All land and/or easements required by this Ordinance shall be
granted to the City of Carlsbad without cost to the City, and free
of a1 1 1 iens and encumbrances.

3. The project shall be constructed with the density shown on the Specific Plan, and shall be constructed in no less a manner than shown on the exhibits labeled "A" and "B".
4. Final elevation and plot plans shall be reviewed by the Director Planning to ensure conformity with the intent of this Specific F
5. The off-street parking facilities shall be constructed in accorc with Chapter 21 .44 of the Carlsbad Municipal Code.
6. Side and rear yards shall be fenced with a six foot high solid f or equal, in compatible materials with those used in the main structure.
7. Exterior lighting shall be provided in the off-street parking a' and shall be shielded so as not to shine or glare on adjacent properties.
8. A parcel map shall be prepared, filed with the City of Carlsbad recorded prior to the issuance of any building permit whatsoeve
9. A strip of land ten (10) feet wide shall be granted to the City street purposes along Harrison Street.
10. Full subdivision improvements shall be constructed to include t undergroundi ng of a1 1 uti 1 i ti es .
11. An approved fire hydrant shall be installed on the west side of Harrison Street, at the intersection of Locust Avenue, type anc installation to the satisfaction of the Fire Chief.
12. On-site fire protection appurtenances shall be constructed in accordance with Fire Department requirements to the satisfactit the Fire Chief. Said fire protection appurtenances shall be installed and functioning prior to framing construction.
13. All building shall be connected to the facilities of the City 1 Carl s bad Water Department.
14. All buildings shall be connected to the City of Carlsbad Publit Sewer System.
15. The proposed design of the swimming pool and jacuzzi shall be revised to the satisfaction of the City's Health Officer.
16. A landscape plan shall be submitted to, and approved by, the C of Planning prior to the issuance of a building permit. Lands Plan shall include provisions for a landscape screen adjacent the 1-5 freeway right-of-way.
17. Provisions will be made for Cable Television.
18. Applicant shall endeavor to obtain a mutual agreement with thc Carlsbad Unified School District to provide for future school requirements that will result from the construction of these residences .
