RESOLUTION NO. 1099 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE SPECIFIC PLAN TO ALLOH THE DEVELOPMENT OF 253 DWELLING UNITS ON PROPERTY LOCATED ON NORTH SIDE OF UNICORN10 STREET BETWEEM AVENUE DE PARAISO AND CHORLITO STREET. CASE rao. SP-132, APPLICANT: PONDEROSA HOMES WHEREAS, a verified application for a certain property, to wit: Portion of the Southwest Quarter of Section 24, Townshjp 12 South, Range 4- West, according to the Official Plat thereof, filed in the Office of the County Recorder- in the County of San Diego, State of California; has been filed with the City of Carlsbad and referred to the Planning Commi s s ion; and WHEREAS, said verified application constitutes a request as provided Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on September 24, 1974; and WHEREAS, the applicant has complied with the Public Facility Policy c City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements ( the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of a1 1 persons who desired to be heard, : Commission considered all factors relating to the Specific Plan and found following facts and reasons to exist: 1. The requested use conforms to all applicable requirements of the Municipal Code. 2. The requested use conforms to the adopted General Plan. NO\, THEREFORE, BE IT RESOLVED, by the Planning Commission of the Cit Carlsbad, California, as follows: That a Specific Plan is approved for us said property to allow development of 253 dwell ing units on property local north side of Unicornio Street between Avenue De Paraiso and Chorlito Strc and subject to the following conditions: 1 2 3 4 5 6 7 8 9 10 11 3.2 13 14 15 16 17 18 19 2Q 21 22 23 24 25 2 6. 27 28 29 30 31 32 0 1. The approval of Specific Plan 132 is granted for the land descri in the application and any attachments thereto and as shown on t plot plan submitted labeled Exhibit A. The location of all buil fences, signs, roadways, parking areas, landscaping, and other facilities or features shall be located substantially as shown o the plot plan labeled Exhibit A. 2. All requirements of any law, ordinance or regulation of the Stat Cal ifornia, City of Carlsbad, and any other governmental entity be complied with. 3. An open-space easement shall be dedicated to the City over lots and 255 as shown on the Specific Plan. These open space areas s be preserved and maintained by a property owners association, an shall be rezoned to open space (0-S) Zone prior to approval of t final map. 4. The setbacks on the individual lots shall conform to all the reo ments and limitations for property located in the R-1 Zone Distr 5. The units shall commence construction on or before the following dates : Unit #1 - April , 1977 Unit #2 - April , 1978 6. Ordinance No. 9332 adopted the Master Plan for the subject propc That ordinance and plan were amended by Ordinance No. 9365 to ac various conditions of approval. Master Plan Condition No. 2 providing for the dedication of Parcels K and K-1 for park purpc is incorporated by reference herein. This Specific Plan is appv on condition that said condition be fully satisfied prior to thc approval of the final map for development of any part of the prc encompassed in this Specific Plan. Any tentative map approved F suant to this Specific Plan shall be subject to the same condit- and the final map may not be approved until Parcel K is deeded 1 and clear to the City of Carlsbad and all other terms of Master Condition No. 2 are fully satisfied. 7. Each individual single-family lot building coverage not to excec 3100 sq. ft.
