PLANNING COMMISSION RESOLUTION NO. 1100
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE MAP TO ALLOW THE DEVELOPMENT OF 253 DWELLING UNITS ON A 100-ACRE SITE LOCATED ON THE NORTH SIDE OF UNICORN10 STREET BETWEEN AVENIDA DE PARAISO AND
APPLICANT: PONDEROSA HOMES
CHORLITO STREET, ZONED P-C. CASE NO. 73-29 ,
WHEREAS, a verified application for a certain property, to wit:
Portion of the Southeast Quarter of Section 24, Township 12 South, Range 4 West, according to the Official Plat thereof, filed in the Office of the County Recorder in the County of San Diego, State of California,
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy (
City of Carlsbad and has provided the necessary information which insures
Pub1 ic Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements t
City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Tenti
Map and found the following facts and reasons to exist:
1. The requested use conforms to the General Plan.
2. The requested use is in compliance with the Subdivision Map Act
L Carlsbad Subdivision Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cit:
Carlsbad, California, as follows: That a Tentative Map is approved for us
said property to a1 low the development of 253 dwell ing units on a 100-acrc
located on the north side of Unicornio Street between Avenida de Paraiso t
Chorlito Street, zoned P-C, and subject to the following conditions:
1. This tentative map is approved on the condition that Master Plar Condition No. 2 and Specific Plan No. 732, Condition No. 6, are satisfied prior to approval of the final nap for this project. dedication of land for recreational facilities will be required this tentative map in satisfaction of the requirements of Chaptt

The development of the property described herein shall be subjec the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions c municipal ordinances and State and Federal statutes now in force which, hereafter, may be in force for the purpose of preserving residential characteristics of adjacent properties.

Trees shall be of a type approved by Parks Department and shall be installed to their specifications. removal of any existing trees is required by the City, said rem0 shall be at the applicant's expense. It shall be the responsibi of the applicant to make all arrangements with the Parks Departm concerning the requirements of this condition.

5. The applicant shall install all required fire hydrants and dry-s pipes prior to framing construction, and said fire appurtenances be functional prior to commencing such work.
6. El Fuerte Street shall be improved in accordance with the specif tions of the City Engineer, or the permittee shall enter into an agreement with the City and shall post a bond in an amount to be determined by the City Engineer guaranteeing the construction of improvements, including bicycle trails.
7. All utilities, including provisions for cable TV, shall be place underground and/or shall be completely concealed from view.
8. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond in tl- amount necessary to energize said street lights for an eighteen period after construction to permit the incorporation of the sul: division into a maintenance district.

10. Street names shall be subject to approval and shall be designate accordance with the standards and policies adopted by the Planni Commission on file in the Planning Department. Said names shall approved by the Planning Director prior to recordation of the fi map.
11. The improvement plans shall include a report of a geological inv gation and a complete grading plan of the entire site. The rep0 and plan shall be prepared by Civil Engineers licensed by the St of California, and experienced in erosion control who shall be acceptable to the City Engineer, and they shall certify that the have investigated the site and prepared data with full considera of the consequences to the included and neighboring properties.
