SPACE LOTS, SECTION OF LA COSTA AVENUE AND RANCHO SANTA FE APPLICANT: LA COSTA LAND COMPANY PLAN TO ALLOW THE DEVELOPMENT OF 179 SINGLE-FAMILY ON PROPERTY LOCATED SOUTHhfESTERLY OF THE INTER- ROAD CONSISTING OF 57.3 ACRES. CASE NO. SP-116, ~~ ~~~ ~ ~~ ~ ~~~~~ ~~~~~~~ ~ ~ WHEREAS, a verified application for a certain property, to wit: Portions of lot 1, of Fractional Section 6, Township 13, South, Range 3 West; portions of lots 1 & 2 of fractional Section 1 , Township 13 South, Range 4 West, S.B.P.4; and portions of lots 3, 4, 9 and 10 of Rancho Las Encinitas, Map No. 848, City of Carlsbad; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as providec Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on October 8, 7974; and WHEREAS, the applicant has complied with the Public Facility Policy the City of Carlsbad and has provided the necessary information which in: Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors relating to the Specific Plan and found the following facts and reasons to exist: ~ 1. NO substantial environmental impacts will occur as a result of this project. 1 2. The project complies with all City Ordinances and Policies, including the Parks Ordinance and the Public Facilities Policy 3. The project conforms to the adopted General Plan for the City of Carlsbad. 32 4. The project conforms to the adopted La Costa Master Plan. 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOW, THEREFORE, .BE IT RESOLVED by the Planning Commission of the Cit, Carlsbad, California, as follows: That a Specific Plan is approved for u s.aid property to allow the development of 179 single-family lots, 3 condominium lots with a maximum density of 20 dwelling units per acre and open space lots on property located southwesterly of the intersection of Costa Avenue and Rancho Santa Fe Road consisting of 57.3 acres, and subje to the following conditions: 1. This approval is granted- for the land described in the applicat and any attachments thereto, and as shown on the plot plan sub- mitted labeled Exhibit A, dated revised September 12, 1974. 2. All setbacks and other development standards for the single-far lots shall conform to those established in the R-1 Zone Distric Coverage of said lots shall not exceed 33-1/3%. 3. Prior to the issuance of any building permits for Lots #180, 18 182 (multiple-family lots), an application for an amendment to Specific Plan shall be submitted to the City for review and apr Said application shall conform to a1 1 of the requirements of ti" (Planned Community) Zone District relating to Specific Plans. Densities shall reflect those recommended in the adopted Genera Plan. 4. Any minor change may be approved by the Planning Director. A program for the maintenance of open space easements (Lots 18: shall be submitted to the Planning Director for approval prior issuance of building permits. 9.
