PLANNING COMMISSION RESOLUTION NO. 1103
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE
LOTS, 3 CONDOMINIUM LOTS WITH A MAXIMUM DENSITY OF
20 DWELLING UNITS PER ACRE AND 8 OPEN SPACE LOTS,
SECTION OF LA COSTA AVENUE AND RANCHO SANTA FE
APPLICANT: LA COSTA LAND COMPANY
MAP TO ALLOW THE DEVELOPMENT OF 179 SINGLE-FAMILY
ON PROPERTY LOCATED SOUTHWESTERLY OF THE INTER-
ROAD CONSISTING OF 57.3 ACRES. CASE NO. CT 73-2,
WHEREAS, a verified application for a certain property, to wit:
Portions of lot 1, of Fractional Section 6, Township 13, South, Range 3 West; portions of lots 1 and 2 of fractional Section 1 , Township 13 South, Range 4 West, S.B.M.; and portions of lots 3, 4, 9 and 10 of Rancho Las Encinitas, Map No. 848, City of Carl sbad;
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy
the City of Carlsbad and has provided the necessary information which ins
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Tent
Map and found the following facts and reasons to exist:
1. No substantial environmental impacts will occur as a result of i this project.
2. The project complies with all City Ordinances and Policies, including the Parks Ordinance and the Public Facilities Policy.
3. The project conforms to the adopted General Plan for the City o Carl s bad.
4. The project conforms to the adopted La Costa Master Plan.
5. The project conforms to the requirements of the California Sub- division Map Act.

condominium lots with a maximum density of 20 dwelling units per acre and
open space lots, on pr0pert.y located southwesterly of the intersection of
Costa Avenue and Rancho Santa Fe Road consisting of 57.3 acres, and subjec
to the following conditions:
1. The Final Map shall be submitted for approval within one year fl the final action by the City Council on the Tentative Subdivisil Map. The Final Map shall be in substantial conformance of the Tentative Subdivision Map known as Exhibit A, dated revised September 12, 1974.
2. The development of the property described herein shall be subjel the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions 1 all municipal ordinance and State and Federal statutes now in f or which, hereafter, may be in force for the purpose of preserv the residential characteristics of adjacent properties.
3. All public improvements shall be made in conformity to the City Carlsbad Engineering Design Criteria and Standard Plans, the Su division Ordinance and other City Standards, to the satisfactio of the City Engineer, without cost to the City of Carlsbad, and free from all 1 iens and encumbrances. Improvement plans for wa and sewer systems shall meet the requirements of the respective service districts.
4. All land and/or easements required by this Ordinance shall be g to the City of Carlsbad without cost to the City and free of a1 liens and encumbrances. No easements shall be recorded prior t recordation of the Final Map unless approved by the City Engine
5. All utilities, including provisions for cable TV, shall be plac underground and/or shall be completely concealed from view.
6. All drainage and flood control facilities shall be approved by County of San Diego Flood Control District prior to installatio
7. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond and/ cash in the amount necessary to energize said lights for an eig month period after construction, to permit the incorporation of subdivision into a maintenance district. This shall be done pr
to approval of Final Map.
8. The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site wh required by the City Engineer. The report and plan shall be prepared by Civil Engineers licensed by the State of California
and experienced in erosion control. Said Engineer shall certif that they have investigated the site and prepared data with ful consideration of the consequences to the included and neighbori properties and conform to the standards of the Geological Safet Element of the General Plan.
9. All slopes created as a result of this development shall not ex a 2:l slope.

In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain a passable vehicular access to all buildings and adequate fire hydrants wi required fire flows and dry-stand pipes shall be installed prio framing construction.

It shall be the responsibility of the appl icant to make a1 1 arrangements with t Parks Department concerning the requirements of this condition. These arrangements are to be made prior to approval of the Fins Map.
Street names shall be subject to approval and shall be designat in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to appro of the Final Map.
The C.C. 8 R's for this development shall be submitted to the Planning Director for review and approval prior to the approval
of Final Map.
An Open Space Easement shall be dedicated to the City over lots
#83-190 as shown on the Tentative Map, prior to approval of the Final Map.
A forty (40) foot Open Space Easement along the sourtherly bour of the subdivision shall be offered for dedication to the City separate instrument prior to approval of the Final Map.
