RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE CONDITIONAL
USE PERMIT TO ALLOW CONSTRUCTION OF A CHURCH ON A .55 ACRE SITE LOCATED ON THE NORTH SIDE OF OAK APPROXIMATELY 600' EAST OF ITS INTERSECTION WITH
JOHN AMOS PI0 PIC0 DRIVE. CASE NO. CUP 80-A, APPLICANT:

7 /I WHEREAS, a verified application for a certain property, to wit:

A portion of Tract 119, Carlsbad Lands, in the City of Carlsbad, County of San Diego, and State of California, according to Map #1661 , fi 1 ed with the San Diego County Recorder on March 1, 1915, and further described on file in the Planning Department;
has been filed with the City of Carlsbad and referred to the Planning

Public Facilities will be available and current with need; and l9
the City of Carlsbad and has provided the necessary information which in: 18
WHEREAS, the applicant has complied with the Public Facility Policy 17
specified in said notice on October 22, 1974; and 16
WHEREAS, the public hearing was held at the time and in the Place 15
Title 21 of the "Carlsbad Municipal Code"; and 14
WHEREAS, said verified application constitutes a request as Provided 13

1. The requested use is necessary or desirable for the developmen the community, is essentially in harmony with the various elem

3. All of the yards , setbacks, wall s , fences , landscaping and othe features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. The required setbacks meet the standards for all o uses in the same neighborhood.
4. The street system serving the proposed use is adequate to prop€ handle all traffic generated by the proposed use and is present sufficient for traffic generated by a church of this size.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cit

1. The Conditional Use Permit is granted for the land as describe( the application and any attachments thereto, and as shown on tl plot plan submitted labeled Exhibit "A", dated 6/3/74. The lo( of all buildings, fences, signs, roadways, parking areas, land. scaping and other facilities or features shall be located sub- stantially as shown on the plot plan labeled Exhibit "A", excel unless otherwise indicated herein. I
2. Unless the construction of the structure or facility is commenc not later than one year after the date the approval is granted is diligently pursued thereafter, this approval will automaticl become null and void.
3. No signs or advertising of any type whatsoever shall be erectem installed until plans therefore have been approved by the City Carl sbad.
4. All areas shown as parking areas shall be surfaced with asphal concrete and shall be visably marked outlining individual park spaces and traffic flow. Said surfacing and marking shall be pleted prior to final inspection of the structure by the Build Department. The surface shall be kept in a reasonably good st of repair at all times. i

5. Any mechanical and/or electrical equipment to be located on th of the structure shall be screened in a manner acceptable to t Planning Director. Detailed plans for said screening shall be mitted, in triplicate, to the Planning Director.

7. A detailed landscape and sprinkler plan prepared by a landscap architect, shall be submitted to the Parks and Recreation Dire for consideration and approval prior to building permit approv

8. All utilities, including electrical, telephone and television,

9. Oak Street shall be improved in accordance with the specificati of the City Engineer, or the permittee shall enter into a futur
agreement with the City guaranteeing the construction of the improvements.
10. Fire fighting equipment as required and approved by the City Fi Department shall be maintained on the premises at all times.
11. A 6 ft. high block wall shall be installed for the full length the north, east and west property lines, except it shall be red to 3-5 ft. within 20 ft. of Oak Avenue.
12. This Conditional Use Permit shall be reviewed by the Planning Commission at five-year intervals from the date of this approva to insure compliance with all conditions and requirements of th Ci ty of Carl s bad.
