HomeMy WebLinkAbout1974-10-22; Planning Commission; Resolution 1108e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 ~ PLANNING COMMISSION RESOLUTION NO. 1108 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE SPECIFIC PLAN TO ALLOW A 135-UNIT DEVELOPMENT ON A 43.2 ACRE SITE, ZONED P-Cy LOCATED ON THE EAST SIDE OF CREST DRIVE BETWEEN ELM AVENUE AND EUCALYPTUS CONSTRUCTION COMPANY AVENUE. CASE NO. SP-160, APPLICANT: KAMAR WHEREAS, a verified application for a certain property, to wit: Those portions of Lots 3, 4, 5, 6, 7, 26 and 27, and of Canon Street is Hosp Eucalyptus Forest Co.'s Tract No. 1 in the City of Carl sbad, County of San Diego, State of California, according to Map thereof No. 1136 filed in the office of the San Diego County Recorder June 8, 1908, has been f i 1 ed with the City of Carl sbad and referred to the P1 anning Commission; and WHEREAS, said verified application constitutes a request as providet Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on October 22, 1974; and WHEREAS, the applicant has complied with the Public Facility Policy the City of Carlsbad and has provided the necessary information which in: Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of a1 1 persons who desired to be heard , said Commission considered all factors relating to the Specific Plan and found the following facts and reasons to exist: 1. The requested use complies with all applicable Municipal Code requirements. 2. The requested use conforms to the adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cit Carlsbad, California, as follows: That a Specific Plan is approved for u of said property to allow a 135-unit development on a 43.2 acre site, zot- 32 P-C, located on the east side of Crest Drive between Elm Avenue and e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I 1 Eucalyptus Avenue, and subject to the following conditions: 1. The approval is granted for the land described in the applicat' and any attachments thereto, and as shown on the plot plan sub. mitted labeled Exhibit A. The location of all buildings % fencc signs, roadways, parking areas, landscaping and other facil itic or features shall be located substantially as shown on the plol labeled Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown or the elevation plans labeled Exhibit B. 2. Unless the construction of the structure or facility is commenc not later than one year after the date the approval is granted is diligently pursued thereafter, this approval will automatic; become null and void. 3. All requirements of any law, ordinance or regulation of the St: California, City of Carlsbad and any other governmental entity be compl i ed with. 4. All areas shown as parking areas shall be surfaced with asphalt concrete and shall be visibly marked outlining individual parki spaces and traffic flow. Said surfacing and marking shall be c pleted prior to final inspection of the structure or structures the Building Department. The surface shall be kept in a reason good state of repair at all times. 5. All outside storage areas shall be screened from adjacent prop€ and streets. 6. Interior landscaping of parking areas shall be provided in a ma acceptable to the Planning Director. Said minimum area of land scaping shall be equivalent to 3% of the area of the lot excl ud required perimeter landscaping. 7. A detailed landscape and sprinkler plan prepared by a landscape architect, shall be submitted to the Planning Director for con- sideration and approval. 8. Prior to final building inspection clearance, all landscaping s be installed. Said landscaping shall , at all times, be maintai in a manner acceptable to the Planning Director. 9. All utilities, including electrical, telephone and cable televi! shall be installed underground and/or shall be completely con- cealed from view. 10. There shall be no ingress or egress to the property except for shown on the plot plan labeled Exhibit A, and as approved by thl City Eng i neer . 11. Street trees , as required by the City, shall be instal 1 ed by thl applicant at his expense. Trees shall be of a type approved by Parks Department and shall be installed to their specifications removal of any existing trees is required by the City, said rem1 shall be at the applicant's expense. It shall be the responsib of the applicant to make all arrangements with the Parks Departn concerning the requirements of this condition. 12. Prior to final occupancy, compliance with and execution of all conditions listed hereon shall be necessary, unless otherwise specified. Pathways in lots 136 and 148 shall be a minimum of 8' in width shall be improved with asphaltic concrete to the satisfaction City Engineer. These pathways shall have a maximum grade of 7 14. Utilities shall be supplied to the Park Site to the satisfacti the City Engineer and Parks Director. 15. The applicant, by written agreement and according to procedure forth in the California Vehicle Code, shall consent to enforce of parking restrictions on all private drives within the devel ment. 16. No phasing of the project shall occur unless an amendment to t specific plan is filed with plans for extending roads and serv to adequately serve each increment of development. 17. On City Park Lots #136 and 140, all street improvements, parki public recreation improvements (such as an open air theatre ar picnic area) as deemed necessary by the Parks Director and Cit Engineer are approved as a part of this Specific Plan. 18. Prior to issuance of building permits, the applicant shall ren debris and litter and thin groves on lots 136, 140 and 148. 1 Parks Department shall determine which trees should be removec 19. This Specific Plan shall expire if construction is not comment PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Ci Planning Commission held on October 22, 1974 by the following vote, to \ January 1 , 1979.
