RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE MAP TO ALLOh! THE DEVELOPMENT OF 135 UNITS ON A 43.2
CREST DRIVE BETWEEN ELM AVENUE AND EUCALYPTUS AVENUE. CASE NO. CT 74-13, APPLICANT: KAMAR CONSTRUCTION
COMPANY
ACRE SITE, ZONED P-C, LOCATED ON THE EAST SIDE OF
WHEREAS, a verified application for a certain property, to wit:
Those portions of Lots 3, 4, 5, 6, 7, 26 and 27, and of Canon Street is Hosp Eucalyptus Forest Co.'s Tract No. 1 in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 1136 filed in the office of the San Diego County Recorder June 8, 1908,
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provide(
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy
the City of Carlsbad and has provided the necessary information which in
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Ten
Map and found the following facts and reasons to exist:
1. The requested use conforms to the adopted General Plan.
2. The requested use complies with requirements of the Subdivisic Act.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Ci
Carlsbad, California, as follows: That a Tentative Map is approved for
said property to allow a 135-uni t development on a 43.2 acre site, zone
P-C, located on the east side of Crest Drive between Elm Avenue and
Eucalyptus Avenue, and subject to the following conditions:
1. The final map shall be submitted for approval within one year the final action by the City Council on the tentative subdivi: map. The final map shall be in substantial conformance of tht tentative subdivision map known as Exhibit A, dated 7-1-74.

2. The development of the property described herein which are in addition to all the requirements , 1 imitations and restrictions all municipal ordinance and State and Federal statutes now in or which, hereafter, may be in force for the purpose of preser the residential characteristics of adjacent properties.
3. All public improvements shall be made in conformity to the Cit Carlsbad Engineering Design Criteria and Standard Plans, the S division Ordinance and other City Standards, to the satisfactir of the City Engineer, without cost to the City of Carlsbad, an' free of all 1 iens and encumbrances. Improvement plans for watl and sewer systems shall meet the requirements of the respectivl service districts.
4. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and f of all liens and encumbrances. No easements shall be recorded to recordation of the Final Map unless approved by the City Eng i neer.
5. All utilities, including provisions for cable TV, shall be pla, underground and/or shall be completely concealed from view.
6. Ornamental street lighting shall be provided for as required bj Municipal Ordinance Code. The developer shall post a bond and, cash in the amount necessary to energize said street lights fol eighteen month period after construction, to permit the incorpc tion of the subdivision into a maintenance district. This shal be done prior to approval of final map.
7. The improvement plans shall include a report of a geological ir gation and a complete grading plan of the entire site when reql by the City Engineer. The report and plan shall be prepared bj
Civil Engineers licensed by the State of California, and exper.
in erosion control. Said Engineer shall certify that they havt investigated the site and prepared data with full consideratiol of the consequences to the included and neighboring properties conform to the standards of the Geological Safety Element of tl General Plan.
8. A1 1 slopes created as a result of this development shall not ex a 2:l slope.
9. Ingress and egress along the property line bordering public str right of way for all lots shall be dedicated, except at locatic specified by the City Engineer. Dedication shall be made prior approval of final map.
10. If requested by the City Engineer, an amended tentative map sha submitted for approval by the City Engineer prior to preparatic the Final Map to assure compliance to all conditions of approva
11. In order to provide for reasonable fire protection during the c struction period, the subdivider shall maintain passable vehicu access to all buildings and adequate fire hydrants with require fire flows and dry-stand pipes shall be installed prior to fram construction.
12. Street trees, when required by the City, shall be installed by applicant at his expense, Trees shall be of a type approved by Parks Department and shall be installed to their specifications removal Of any existing trees is required by the City, said rem shall be at the applicant's expense. of the applicant to make all arrangements with the Parks Depart concerning the requirements of this condition. These arrangeme are to be made prior to approval of the final map.
13. Street names shall be subject to approval and shall be designat accordance with the standards and policies adopted by the Plann Commission on file in the Planning Department. Said names shal approved by the Planning Director prior to approval of the fina map.
14. The C.C. & R’s for this development shall be submitted to the Planning Director for review and approval prior to the approval final map.
15. Property 1 ine return radii at Monroe Street intersections shall 25’.
16. The developer shall participate in traffic signal installations Hosp Way and El Camino Real , Monroe Street and Marron Road, and Elm Avenue and Monroe Street as determined by any future policy the City Council.
17. Lots 136 and 140 shall be dedicated in fee title to the City of Carlsbad prior to approval of the final map.
18. An Open Space Easement granted to the City of Carlsbad over lot concurrent with recordation of the final map.
19. Lots 136, 140 and 148 shall be rezoned to 0-S (Open Space) zonc prior to approval of the final map.
20. Hosp Way, as shown on the approved Hosp Grove Master Plan, shal fully completed prior to occupancy of the first unit of develol
