HomeMy WebLinkAbout1974-11-12; Planning Commission; Resolution 1117# a a 1 2 3 4 5 6 7 8 9 10 11 12 13 3.4 15 16 1'7 18 19 20 21 22 23 24 25 26, 27 28 29 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1117 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE OF PROPERTY LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN ELM AVENUE EXTENDED AND CHESTNUT AVENUE APPLICANT: INVESTOR'S DEVELOPMENT AND MORTGAGE CORPORATION. SUBDIVISION MAP FOR 264-LOTS ON A 83.25 ACRE PIECE ZONED R-1-7500 AND R-1-9000. CASE NO. CT 74-14, WHEREAS, a verified application for a Certain property, to wit: All that portion of Lot "J" of Rancho Aqua Hedionda, according to Partition Map No. 823 filed with the San Diego County Recorder, and further described in the files of the Carlsbad City Planning Department; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy the City of Carlsbad and has provided the necessary information which ins Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, said Commission considered all factors relating to the Tent Subdivision Map and found the following facts and reasons to exist: I. The project, as shown on Exhibit D on file in the Planning Depa conforms to adopted General Plan. 2. The Exhibit D project meets all requirements of the R-1-7500 ar R- 1-9000 zones. 3. The Exhibit D project meets the requirements of the Subdivisior Act and City of Carlsbad Subdivision Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cii Carlsbad as follows: A. That the above recitations are true and correct. B. The Final Map shall be submitted for approval within one y from the final action by the City Council on the Tentative division Map. The Final Map shall be in substantial confo of the Tentative Subdivision Map known as Exhibit D, dated 11/12/74, on file in the City of Carlsbad Planning Departm 2- The development of the property described herein shall be subject to the restrictions and limitations set forth here which are in addition to all the requirements, limitations restrictions of all municipal ordinance and State and Fede statutes now in force, or which, hereafter, may be in forc the purpose of preserving the residential characteristics adjacent properties. 3. All public improvements shall be made in conformity to the of Carlsbad Engineering Design Criteria and Standard Plans Subdivision Ordinance and other City Standards, to the sat faction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improve plans for water and sewer systems shall meet the requireme the respective service districts. 4. All land and/or easements required by this Ordinance shall granted to the City of Carlsbad without cost to the City a free of all liens and encumbrances. No easements shall be recorded prior to approval of the Final Map unless approve the City Engineer. 5. All utilities, including provisions for cable TV, shall be placed underground. 6. Ornamental street lighting shall be provided for as requir Municipal Ordinance Code. The developer shall post a bonc or cash in the amount necessary to energize said street li for an eighteen month period after construction, to permit incorporation of the subdivision into a maintenance distri This shall be done prior to approval of Final Map. 7. The improvement plans shall include a report of a geologic investigation and a complete grading plan of the entire si when required by the City Engineer. The report and plan 5 be prepared by a Civil Engineer licensed by the State of California, and experienced in erosion control. Said Engi shall certify that they have investigated the site and prc data with full consideration of the consequences to the ir and neighboring properties and conform to the standards 01 Geological Safety Element of the General Plan. 8. All slopes created as a result of this development shall I exceed a 2: 1 slope, except as approved by the City Enginet 9. In order to provide for reasonable fire protection during construction period, the subdivider shall maintain passab- vehicular access to all buildings and adequate fire hydrar with required fire flows and dry-stand pipes shall be ins1 prior to framing construction. 10. Street trees, when required by the City, shall be installe the applicant at his expense. Trees shall be of a type ap by the Parks Department and shall be installed to their sp cations. If removal of any existing tree is required by t City, said removal shall be at the applicant's expense. I shall be the responsibility of the applicant to make a71 a ments with the Parks Department concerning the requirement this condition. These arrangements are to be made prior t approval of the Final Map. 6 7 8 12. Street names shall be subject to approval and shall be des nated in accordance with the standards and policies adopt€ the Planning Commission on file in the Planning Department Said names shall be approved by the Planning Director prio approval of the Final Map. 9 10 13. The C.C. & R's for this development shall be submitted to Planning Director for review and approval prior to the app of Final Map. 11 14. A secondary access to Elm Avenue shall be completed prior 32 occupancy of Phases 2, 3 and 4. 13 14 15 16 15. The City shall acquire and the applicant shall purchase fr the City the small offsite parcel which will be created at northwest corner of the intersection of Caldwell Lane and Avenue. This parcel shall be added to Lot 149 prior to Fi Map approval. I/ 16. No sewage pump stations will be allowed, except on a tempc basis as approved by the City Engineer. 17 11 18 19 17. All cul-de-sacs on the site shall have a maximum length of feet , except as approved by the City Engineer. 18. The applicant shall bond for half offsite construction of Caldwell Lane and Elm Avenue as shown on the tentative map 20 21 19. The maximum allowable street grade through an intersection be 9%. 22 23 24 I 25 I 2 6, 27 28 29 30 31 32 20. The applicant shall dedicate in fee title to the City, lot B and D and open space easement over Lot C concurrent with Council approval of the Final Map for Phase I. The slope areas shown as the rear portion of lots 28-32, 3 and 43-50 shall be granted to the City as an open space ea ment prior to City Council approval of the final map for P I. The applicant shall provide the following within these ope space lots and easements prior to final map approval for PI I: a) Landscaping and a fully automated sprinkler system acceptable to the Parks and Recreation Director; b) A 10 foot wide, maximum 7% grade asphaltic concrete p' extending from Chestnut Avenue and joining the path o CT 74-4 at their mutual boundary. Alignment of "A" Street on CT 74-4 and Caldwell Street shal occur prior to Final Map approval. 22.
