RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE CONDITIONAL USE PERMIT TO ALLOW A TEMPORARY SALES FACILITY UNDER
THE PROVISION OF MUNICIPAL CODE SECTION 21.42.06. SUBJECT PROPERTY IS LOCATED ON THE SOUTH SIDE OF
COSTA DEL MAR ROAD BETWEEN LA COSTA AVENUE AND ARENAL
APPLICANT: LA COSTA LAND COMPANY ROAD, AND IS ZONED R-P. CASE NO. CUP-102,

WHEREAS, a verified application for a certain property, to wit:
A1 1 of Lot 3 , La Costa Condomi ni um No. 4, according to Map 6250 on file in the office of the San Diego County Recorder and a portion of Lot 143 Sec. 35, Township 125, R4W, San Bernardino Meridian, in the City of Carlsbad, and further described in the files of the Carlsbad City Planning Department;
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on December 10, 1974; and
WHEREAS, the applicant has complied with the Public Facility Policy o
the City of Carlsbad and has provided the necessary information which insu
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements c
City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, !
Commission considered all factors relating to the Conditional Use Permit i
found the following facts and reasons to exist:
1. The requested use is necessary or desirable for the development
community, is essentially in harmony with the General Plan, and
detrimental to existing or permitted uses in the zone in which to be located because: (a) It will consolidate visitor and sa
information activities in La Costa; and (b) It conforms to the
adopted General Plan designation for offices;
2. The site for the intended use is adequate in size and shape to accomodate the intended use because it will take up only a smal portion of the landscaped lot on which it is to be located;
3. All yards, setbacks, walls, fences, landscaping and other featu necessary to adjust the use to the neighborhood are adequate be

(a) The use is already similar to and compatible to existing USE the vicinity (namely the La Costa Spa/Hotel and Horse Stables), a
(b) The setbacks and landscaped open lot area will be very exter
4. The street system serving the proposed use is adequate to handle
traffic generated because it is adjacent to the prime arterial of
Camino Real.
5 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City

7 A) That the above recitations are true and correct.

B) That a Conditional Use Permit is approved to allow a temporary st
facility under the provision of Municipal Code Section 21.42.06. Subject property is located on the south side of Costa del Mar Rc between La Costa Avenue and Arena1 Road, and is zoned R-P, and i: subject to the following conditions:
1 ) The approval is granted for the land described in the appl ic and any attachments thereto, and as shown on the plot plan 5 mitted labeled Exhibit A, 11/20/74, on file in the Carlsbad Planning Department. 6) A detailed landscape and sprinkler plan prepared by a lands architect, shall be submitted to the Planning Director for sideration and approval.

8) The parking area and landscaping as shown on the plot plan (labeled Exhibit A, 11/20/74) shall be constructed prior to occupancy of temporary trailer.
9) All driveways (access lanes) on the site shall be a minimum
