ABBEY ONE LOT SOUTH OF SEQUOIA AVENUE. CASE NO. CT 72-38, WHEREAS, a verified application for a certain property, to wit: All of lots 1, 2 and 18 of Block 1 and all of lots 1 through 6 inclusive and lot 20, Block H of Palisades according to Map No. 1747 filed with the San Diego County Recorder, and further described in the files of the Carlsbad City Planning Department, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, said Commission considered all factors relating to the Tent Map and found the following facts and reasons to exist: 1. The project conforms to the Carlsbad Municipal Code and General 2. The project meets all requirements of the subdivision map act. 3. The project meets the City's Public Facilities Policy. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cit Carlsbad as follows: A) That the above recitations are true and correct. B) That a Tentative Map is approved to allow a 2-lot condominium s division on 1.3 acres zoned RD-M and located on the east side c Carl sbad Boulevard between Tamarack Avenue and one lot south of Sequoia Avenue, and subject to the following conditions: 1) The Final Map shall be submitted for approval within one J from the final action by the City Council on the tentativc subdivision map. The Final Map shall be in substantial cc .formance of the Tentative SubdivisiGn Map known as Exhibit dated November 4, 1974, on file in the Carlsbad City Planr Department. f 4 .1 2 3 4 5 6 7 8, 9 10 11 32 13 94 15 16 17 18 19 20 23 22 23 24 25 2 6, 27 28 29 30 31 32 I 0 0 2) The development of the property described herein shall be SI to the restrictions and limitations set forth herein which i in addition to all the requirements, limitations and restrictions of all municipal ordinance and State and Feder, statutes now in force, or which, hereafter, may be in force the purpose of preserving the residential characteristics 0' adjacent properties. 3) A1 1 public improvements shall he made in conformity to the 1 of Carlsbad Engineering Design Criteria and Standard Plans, Subdivision Ordinance and other City Standards, to the sati: faction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvem plans for water and sewer systems shall meet the requiremen of the respective service districts. 4) A1 1 land and/or easements required by this Ordinance shall granted to the City of Carlsbad without cost to the City ar free of a1 1 1 iens and encumbrances. No easements shall be recorded prior to approval of the Final Map unless approvec the City Engineer. 5) A11 utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed frc view. 6) Ornamental street lighting shall be provided for as requirc Municipal Ordinance Code. The developer shall post a bond or cash in the amount necessary to energize said street li! for an eighteen month period after construction, to permit incorporation of the subdivision into a maintenance distric This shall be done prior to approval of Final Map. 7) The improvement plans shall include a report of a geologic investigation and a complete grading plan of the entire si when required by the City Engineer. The report and plan s be prepared by Civil Engineers licensed by the State of California, and experienced in erosion control. Said Engi shall certify that they have investigated the site and pre data with full consideration of the consequences to the in and neighborhing properties. 8) All slopes created as a result of this development shall n exceed a 2: 1 slope. 9) Ingress and egress along the property 1 i ne bordering pub1 i street right of way for all lots shall be dedicated, excep location as specified by the City Engineer. Trees shall be of a type approved by the Farks Department and shall be installed to specifjcations. If removal of any existing trees is requi the City, said removal shall be a,t the applicant's ex!,,, Inrse shall be the responsibil i ty of the appl icant to make all r= with the Parks Department concerning the requirements OF this condition. These arrangements are to be made prior t approval of the Final Map. 14) f'he C.C. & R's for this development shall he submitted tu Planning Director for review and approval prior to the ap~ of Final Hap. 15) Prior to approval of the f!'nal nap by the City Council, a hearing will be conducted to assess the requested vacatior Sequoia Avenue: a) In the event the vacation of Sequoia P,,venue is approb the City Ccuncil , the appl icant shall be rcspo\?si bl e the fo71 owing : 1 ) Removal of existing pavement and strwt iinproven 2) Constmction of a cul de sac turn around with a radius; 3) Construction of a 10' wide paved bicycle !and ar way through to Carlsbad Boulevard which could 3- serve as a utility maintenance vehicle cccess; 4) The installation of landscaping over the rernainc the vacated street. b) In the event the vacation of Sequoia Avenue is not a] by the City Council, the app?icant shall be responsil for the dedication of five feet on both sides of Seq Avenue, and shall be responsible for full street. imp: ments within the public right of way. 16) The applicant shall offer to the City an Open Space Easernl for public access and recreatjon purposes over the wester] of Lot 2 (comprisin? an area of 60' x 100') concurrent wi, Council approval of the Final Map. This Open Space Easemj shall be improved according to the Plan labeled Exhibit C dated 1 1 /4-/74. 17) The apnl icant shall execute a future agreement to instal 1 plete half street improvements to C.!!rl sbad Boulevard alon division frontage. This shall be accomplished prior to F Ma!, approval.
