HomeMy WebLinkAbout1974-12-10; Planning Commission; Resolution 1122.,- a? 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2-9 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1122 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE MAP TO ALLOW A 50-LOT SUBDIVISION ON A 15.211 ACRE SITE ZONED R-1-10,000 AND R-1-8,000 ON PROPERTY LOCATED ON REFUGIO AVENUE AND NEBLINA DRIVE EXTENDED AT THE INTERSECTION OF HILLSIDE DRIVE. CASE NO. RIVIERA PARTNERSHIP. CT 74-19, APPLICANT: JERRY ROMBOTIS, FOR LAGUNA -~ ~~ ~~~ "~~~ ~ ~~ ~~ WHEREAS, a verified application for a certain property, to wit: A portion of Lot 1, Rancho Aqua Hedionda, according to Map #823 filed with the Office of the San Diego County Recorder on December 16¶ 1896, and further described on file in the Carl sbad Ci ty P1 anning Department , has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided Title 21 of -the "Carl sbad Municipal Code"; and WHEREAS , the appl icant has complied with the Publ ic Facil i ty Pol icy ( City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements 1 City of Carl sbad "Environmental Protection Ordinance of 1972"; and WHEREAS, said Commission considered all factors relating to the Tent Map and found the following facts and reasons to exist: 1. The tentative map complies with the approved Precise Plan for t entire Laguna Riviera Subdivision. 2. The tentative map meets all requirements of the Carlsbad Munici Code, General Plan and Publ ic Facilities Policy. 3. The tentative map complies with all requirements of the Subdivi Map Act. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cil Carl sbad as foll ows: A) That the above recitations are true and correct. B) That a tentative map is approved to allow a 50-lot subdivision 15.211 acre site zoned R-1-10,000 and R-1-8,000 on property lo( on Refugio Avenue and Neblina Drive extended at the intersectic Hillside Drive, and subject to the following conditions: . ,b' 3 2 3 4 5 6 7 8 9 10 PI. The Final Map shall be in substantial confor of the Tentative Subdivision Map known as Exhibit A, dated 11/4/74, on file in the Carlsbad City Planning Department. 2) The.deve1opment of the property described herein shall be 5 to the restrictions and limitations set forth herein which in addition to all the requirements, limitations and restrictions of all municipal ordinance and State and Feder statutes now in force, or which, hereafter, may be in forcf the purpose of preserving the residential characteristics ( adjacent properties. 3) All public improvements shall be made in conformity to the of Carlsbad Engineering Design Criteria and Standard Plans Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the Cit: Carlsbad, and free of all liens and encumbrances. No easements shall be recorded prior to approval of the Final Map unless approve the City Engineer. 5) All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed fr view. 6) Ornamental street lighting shall be provided for as requir Municipal Ordinance Code. The developer shall post a bond or cash in the amount necessary to energize said street li for an eighteen month period after construction, to permit incorporation of the subdivision into a maintenance distri This shall be done prior to approval of the Final Map. 7) The improvement plans shall include a report of a geologic investigation and a complete grading plan of the entire si when required by the City Engineer. The report and plan s be prepared by Civil Engineers licensed by the State of California, and experienced in erosion control. Said Engi shall certify that they have investigated the site and pre data with full consideration of the consequences to the in and neighborhing properties. 8) All slopes created as a result of this development shall n exceed a 2:l slope, except as approved by the City Enginee 9) Ingress and egress along the property line bordering publi' street right of way for all lots shall be dedicated, excep location as specified by the City Engineer. Trees shall be of a type app by the Parks Department and shall be installed to their specifications. If removal of any existing trees is requir the City, said removal shall be at the applicant’s expense. shall be the responsibility of the applicant to make a1 1 ar ments with the Parks Department concerning the requirements this condition. These arrangements are to be made prior to approval of the Final Map. 13) All conditions of the original Tentative Map, City Council Resolution No. 1292 and identified as Exhibit 5, dated Augu 2, 1966, shall remain in effect. 14) All lots within this subdivision shall meet minimum lot si2 requirements of the approved Precise Plan (PP #7).
