CASE NO: CUP 103 APPLICANT: LARRY ROHLOFF (Nazarene Church) WHEREAS, a verified application for a certain property, i wit: A portion of tract 5, Laguna Mesa Tracts, according to Map 1719 filed with. the San Diego County Recorder, in th.e City of Carlsbad, County of San Diego, State of California; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provi.ded by Title 21 of the "Carlsbad Municipal Code"' and WHEREAS, the public hearing was held at the time and in . glace specified in said notice on January 14, 1975; and WHEREAS, the applicant has complied with the Public Faci' Policy of the City of Carlsbad and has provided the necessary informatian which insures Public Facilities will be available current with need; and MHEREAS, at said public hearing, upon hearing and considl the testimony and arguments, if any, of all persons who desirl to be heard, said Commission considered all factors relating the Conditional Use Permit and found the following facts and reasons to exist: 1) The use is necessary and desirable for the developm of the community, is in harmony with the General P1 and is not detrimental to uses in the R-1 Zone beca a) The General Plan and Zoning allow churches in R-1 Zone when it is proven they can be adjuste the neighborhood; b) The use will provide a needed service to the community. This is larger than all except one church existing presently in Carlsbadi b) The lot is regularly shaped and can easily ac'commodate the proposed use. All of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the use to existing or permitted future uses in the neighborhood will be provided and maintained as follows: 4 The project will be required to meet all setbacks of the R-l Zone; b) A view obscuring fence or hedge is being required along all property boundarieswhich abut dwelling units. .' cl A landscape plan which will buffer the use from the surrounding neighborhood is being required. The street system serving the proposed use is adequate to handle all traffic generated by the use because: a> The site is located at the intersection of two residential collector streets. b) The site has excellent access to I-5. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That a Conditional Use Permit is approved to allow construction of a Church and related facilities on' property located at 2675 Highland Drive, and is subject to the following conditions: 1) The approval is granted for the land d,escribed in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated 12-2-74. The location of all buildings, fences, signs, roadways, parking areas, landscaping, and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of.the design as shown on the elevation plans labeled Exhibit B, dated 12-2-74. 2) Al.1 requirements of any law, ordinance or regul'a- tion of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. -2- 0 0 x 2 3 4 5 6 7 8 9 10 91 32 13 14 3.5 16 17 18 39 28 21 22 23 24 25 26 27 28 29 30 31 32 3) 4) 5) 6) 7) 8) 9) 10) 111 12) No signs or advertising of any type whatsoever shall be erected or installed until plans therl fore have been approved by the City of Carlsbal All areas shown as parking areas shall be surfl with asphaltic concrete and shall be visibly marked outlining individual parking spaces and traffic flow. Said surfacing and marking shal be completed prior to final inspection of the structure or structures by the Building Depart1 The surface shall be kept in a reasonably good state of repair at all times. All lighting shall be arranged to reflect away from adjoining properties and streets. All outside storage areas shall be screened fr adjacent property and streets. An incombustible trash enclosure shall be prov of a size and location acceptable to the Plann Director, and said area shall be enclosed with fence and/or wall of sufficient height to adequately shield the area. Said fence and/or wall shall include a solid gate. A detailed landscape and sprinkler plan prepar by a landscape architect, shall be submitted t the Parks and Recreation Director for consider and approval. Said landscape plan shall show effective screening of the use from adjacent properties. Landscaping shall cover all open shown on the plot plan, except those used for ways. All utilities including electrical, telephone cable television, shall be installed undergrou and/or shall be completely concealed from view All public improvements shall be made in con- formity with the Subdivision Ordinance and 0th City Standards, to the satisfaction of the Cit Engineer without cost to the City of Carlsbad free of all liens and encumbrances. Prior to any construction, the applicant shall submit plans to the appropriate entity providi domestic water to the proposed development, fo its approval of the location, type and adequac of water lines, and to this Fire Department fo approval of the location of fire hydrants. Street trees, as required by the City, shall b installed by the applicant at his expense. Tr shall be of a type approved by the Parks Depar ment and shall be installed to their specifica If removal of any existing trees is required b City, said removal shall be at the applicant's expense. It shall be the responsibility of th applicant to make all arrangements with the Pa Department concerning the requirements of this condition. -3- .I 2 3 4 5 6 7 8 9 10 31 -12 13 14 15 16 3.7 18 19 20 21 22 23 24 25 2 6, 27 28 29, 30 31 32 I e 0 13) The applicant shall install all required fire hydrants and dry-stand pipes prior to framing construction, and said fire appurtenances shal be functional prior to commencing such work. 14) The project shall be phased as follows: PHASE CONSTRUCTION START Phase IA January 1976 Phase IB January 1977 Phase I1 January 1978 Phase I11 January 1980 The Planning Director may grant a one year extension for each phase of development. If construction for a phase does not commence by appointed date, this Conditional Use Permit wi become null and void. 15) The parking stalls shown on Exhibit A shall be provided concurrent with the first phase of th development. 16) The applicant shall dedicate additional right way to provide for a 30' half street section o Highland Drives and shall enter into a future agreement with the City to construct complete half-street improvements along Highland Drive. 77) Applicant shall construct the following improv men ts : a) Curb, gutter and sidewalk along Las Flore Drive per City of Carlsbad Drawing No. 13 b) Cleanout at end of sewer stub in norther1 extension of Morning Glory Lane. c) One fire hydrant at end of water line in northerly extension of Morning Glory Lane and one on-site fire hydrant, centrally located. The on-site hydrant shall be se from a public water line extension from Highland Drive, having an alignment and capacity approved by the Fire Department l City Engineering Department. These shall installed prior to building construction. d) One 7000 Lumen ornamental street lights o Las Floress per City Standards. e) Curb outlets in Las Flores as needed to handle drainage, per City Standards. 18) Approval of a final parcel map (PS-205) to consolidate lots is required prior to issuance of building permits. 19) Prior to occupancy, the applicant shall instal a view obscuring grapestake and masonry pillar fence along all property boundaries abutting single family residences. -4- -, I) 0 e II 1 2 3 4 5 6 7 8 9 10 I1 3.2 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on January 14, 1975 by the following vote, to wit: AYES: COmmiSSiOnerS Watson, L'Heureux, Casler, Fikes and Jose NOES: None ABSENT: Commissioners Wrehch and Dominguez ATTEST: 13 14 15 18 19 20 21 22 23 24 25 2 6, 27 28 29 30 31 32 -5-
