PLANNING COMMISSION RESOLUTION NO. 11 28
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE SPECIFIC PLAN
SHOPPING CENTER TO BE CONSTRUCTED IN FIVE PHASES. SUBJECT PROPERTY IS LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN HAYMAR DRIVE AND MARRON ROAD.

AMENDMENT TO ALLOW THE KELLY-KURLANDER-VANDENBURG
CASE NO. SP-l46(A), APPLICANT: AZALEA, INC. , by
WHEREAS, a verified application for a certain property, to wit:
Parcels 1 and 2 of Parcel Map No. 487 as shown on map recorded at Page 487 of Parcel Maps, Records of San Diego County, State of California. Also, a portion of Lot.4, fraction Section 32, Township 11 S, Range 4 W, San Bernardino Meridian, and further described in the files of the Planning Department;
has been filed with the City of Carl sbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on January 28, 1975; and
WHEREAS, the applicant has complied with the Public Facility Policy c
the City of Carlsbad and has provided the necessary information which ins6
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements c
the City of Carlsbad "Environmental Protection Ordinance of 1972", becausc
Environmental Impact Report was certified by the City Council concurrent \r
a zone change and specific plan approving a shopping center on the subjecl
property. The Planning Director has determined that the subject proposal
meets the requirements of CEQA and the Carlsbad Environmental Protection
Ordinance for reason of prior compliance because it involves no changes ir
either the project or the circumstances under which it is to be developed;
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, !
Commission considered all factors relating to the Specific Plan Amendment
found the following facts and reasons to exist:
1. The proposed phasing meets all policy and ordinance requirement:

the City of Carl sbad.
2. The proposed phasing will not adversely affect the approved Specifi P1 an.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carl sbad as fol lows:
A) That the above recitations are true and correct.
B) That a Specific Plan Amendment is approved to allow the Kelly- Kurlander-Vandenburg Shopping Center to be constructed in five pha: Subject property is located on the east side of El Camino Real bet1 Haymar Drive and Marron Road, and is subject to the following condi ti ons :
1) The Specific Plans are granted for the land described in the application and any attachments thereto, and as shown on the I plan submitted labeled Exhibit A, dated 10/23/73, except or u! indicated otherwise herein.
2) Prior to the issuance of any permits, a parcel map outlining parcels, shall be submitted to the City of Carlsbad for con- sideration and approval.
3) Prior to the issuance of any permits, abandonment proceedings shall be completed on Osuna Drive or an encroachment permit m be obtained.
4) Prior to the issuance of any permits, a revised specific plar shall be submitted to the Planning Director for consideratior approval showing the following:
a) The deletion of the approximate ten acres measured from top of the bank as shown on Specific P1 an, Exhibit A, dt 10/23/73, the easterly boundary of the subject property.
b) The revision of the egress and ingress from the subject development to El Camino Real. The major access shall t provided in line with the main entrance from El Camino F to the existing Plaza Camino Real to the west. All othc access points to El Camino Real shall be on the basis 01 right turn in an right turn out only. The final circuli design shall be as approved by the City Engineer.
c) The relocation of any proposed building areas to accommc the final accesses to El Camino Real.
5) Except for approved accesses, all vehicular access rights to public streets should be dedicated to the City of Carlsbad a part of the consideration of any parcel map.
6) The developer shall be required to install in a manner accep to the City Engineer, any necessary improvement to provide f protection from potential flooding, including a desilting ba at the beginning of construction, or thereafter as required the City Engineer.
7) Storm drains shall be constructed in a manner acceptable to City Engineer in conformance with the City's master drainage plan.

Water main shall be extended along Haymar Drive as required h the City Engineer.
No development shall occur until sewer capacity is available the Vista trunk line or other provision acceptable to the Cit Engineer is made to provide sewer to the subject property.
Upon availability of sewer capacity, the developer shall inst a sewer line to serve the subject property which shall be cor patible with the City's Master Sewer Study for the area and d conform to City Standards.
Haymar Drive shall be dedicated and improved to City Standarc the basis of a 40 ft. curb to curb street section.
Marron Road shall be dedicated and improved to City Standards the basis of an 84 ft. right-of-way width for the full front? of the subject property.
The developer shall participate in the construction and/or revision of the traffic signal system on El Camino Real to accommodate the subject development.
Unless the construction of the structure or facility is commt not later than one year after the date the approval is grantt and is diligently pursued thereafter, this approval will aut( matically become null and void.
Any minor change may be approved by the Planning Director. I substantial change will require the filing of an application an amendment to be considered by the Planning Commission.
All requirements of any law, ordinance or regulation of the ! of California, City of Carlsbad and any other governmental el shall be complied with.
No signs or advertising of any type whatsoever shall be erec' or instal 1 ed unti 1 pl ans therefore have been approved by the of Carlsbad. Prior to issuance of any permits for signs, a program for the total development shall be submitted to the Planning Commission for consideration and approval. Said si1 program shall conform to the City's sign limitations in effel at the time of development. Said development for sign purpo shall be considered a single development.
All areas shown as parking areas shall be surfaced with asph concrete and shall be visibly marked outlining individual pa spaces and traffic flow. Said surfacing and marking shall b completed prior to final inspection of the structure or structures by the Building Department. The surface shall be in a reasonably good state of repair at all times. Parking the total development shall be provided on the basis of a mi mum of one parking space for each 400 sq. ft. of gross floor
Prior to obtaining a building permit and within 30 days here the applicant shall file with the Secretary of the Planning Commission written acceptance of the conditions stated herei
Compliance with and execution of all conditions listed hereo shall be necessary, unless otherwise specified, prior to obt
ing a final building inspection clearance. Deviation from t requirement shall be permitted only by written consent of th Planning Director.

21) Any mechanical and/or electrical equipment to be located on t! roof of the structure shall be screened in a manner acceptable the Planning Director. Detailed plans for said screening shal be submitted, in triplicate, to the Planning Director.
22) The 1 ighting of the sign shall be accomplished in such a mannc that there shall be no reflection on adjacent properties or streets which may be considered either objectionable by adjacc property owners or hazardous to motorists.
23) Incombustible trash enclosure to serve each phase of the devel ment shall be provided of a size and location acceptable to tk Planning Director, and said area shall be enclosed with a fen1 and/or wall of sufficient height to adequately shield the are; Said landscaping shall be provided in the following manner:
a) A perimeter planter of a size of 10 ft. wide shall be provided except for approved openings, adjacent to all publ ic streets.
b) A minimum of 5% of the total parking areas shall be land caped. Said areas shall be so located so as to break up massive expanse of paved area.
c) The sum of a71 the landscape areas shall not be less tha 7 5% of the total net land area.
d) Concrete curbing shall be provided for planters located parking areas.
24) Prior to final building inspection clearance for each phase, landscaping shall be installed. Said landscaping shall, at e times, be maintained in a manner acceptable to the Planning Director.
25) All utilities, including electrical, telephone and cable tele vision, shall be installed underground and/or shall be comple concealed from view.
26) A1 1 publ ic improvements shall be made in conformity to the Ci of Carlsbad Engineering Design Criteria and other City Stand; and the Subdivision Ordinance to the satisfaction of the CitJ Engineer, without cost to the City of Carlsbad, and free of E liens and encumbrances. Improvement plans for water and sev system shall meet the requirements of the respective service districts.
27) The architecture of the development shall be of the Hispanic character as established in the scenic corridor along El Cam' Real. Building elevations shall be submitted to the Plannin! Commission for consideration and comment prior to any'deve70 ment.
28) Phasing of SP-146 shall be according to those phases numbere A through E as shown on the plot plan labelled Exhibit D, da 7/21/75, on file in the Planning Department.
29) The public improvements for SP-146 shall be provided with th respective phases as follows:

PHASE A:
a) Initiate street vacation of Osuna Drive right of way to vacation before expiration of temporary encroachment per
b) Construct complete storm drain from Marron Road to down- stream connection to existing drain, subject to approval
City Engineer, and dedicate easements from same.
c) Construct complete pub1 ic improvements, (including curb, gutter, sidewalk, any additional fire hydrants, and miss bell street lights) along entire E7 Camino Real frontage
d) Extend all utilities, including sewer and water, require for ultimate development and dedicate easements for same through Phase A.
e) Construct public improvements at Marron Road entrance.
f) Waiver direct access rights to El Camino Real and Marron Road except at entrances shown.
PHASE B:
a) Construct complete public improvements along entire Marr Road and Haymar Drive frontage. Access to Haymar Drive from El Camino Real shall be right turn in and right tur out only.
b) Construct a1 1 water and sewer 1 ines and dedicate easemen for same.
c) Redesign and revise existing intersection improvements across from Phase B access to El Camino Real to integrat traffic movements across and on to El Camino Real. Such work shall include rechannelization, restriping, signal utility relocation as approved by the City Engineer.
d) Convert Phase A access to El Camino Real to right turn i and out only.
PHASE Cy D AND E:
a) Construct additional fire hydrants as required by the Fi
