HomeMy WebLinkAbout1975-01-28; Planning Commission; Resolution 1131c 9 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1131 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING APPROVAL OF A LOCATED ON THE EAST SIDE OF LAGOON LANE BETWEEN POINSETTIA LANE AND THE BATIQUITOS LAGOON. CASE LA COSTA PARTNERSHIP ZONE CHANGE FROM RD-M TO R-1-7500 ON A 1.5 ACRE PARCEL NO. ZC-150, APPLICANT: DONALD B. AYRES FOR RANCHO WHEREAS, a verified application for a certain property, to wit: Beginning at the center of Section 28 thence northerly along the quarter Section line, north 0028'17" East 133.00 ft; thence South 89007'00" West, 282.00 ft; thence South 77042'00" East, 444.33 ft. to the northerly line of North half, Southeast quarter Section 28, thence along said Northerly line, North 89007'00" West, 705' to the point of beginning, and further described in the files of the Carlsbad City Planning Department; (Exhibit A, 12/27/74); - has been filed with the City of Carl sbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place speci in said notice on January 28, 1975; and WHEREAS, the applicant has complied with the Public Facility Policy of City of Carlsbad and has provided the necessary information which insures Pv Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of City of Carlsbad "Environmental Protection Ordinance of 1972", since this project was covered by the EIR for the Ayers Master Plan application. It hz been determined that a new EIR is not necessary since the project has not significantly changed from that anticipated in the Ayers Master Plan; and WHEREAS, at said public hearing, upon hearing and considering the test' and arguments, if any, of all persons who desired to be heard, said Commiss- considered all factors relating to the Zone Change and found the following 1 and reasons to exist: 1. The zone change will correspond zoning boundaries to existing sub- division boundaries. 2. The zone change is consistent with the General Plan and all other City policy and ordinance requirements. r m 0 1 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 0' 2 Carlsbad as follows: 3 4 A) That the above recitations are true and correct.
