CASE NO. CT 73-39, APPLICANT: DONALD 6. AYRES, for RANCHO LA COSTA PARTNERSHIP MAP TO ALLOW A 307-LOT SUBDIVISION OVER 92.8 ACRES WHEREAS, a verified application for a certain property, to wit: N. 1/2, S.E. 1/4, Section 28, T.125, Range 4 west, San Bernardino Meridian and portions of S.W. 1/4, N.E. 1/4, Section 28 and portion of N.W. 1/4, S.W. 1/4, Section 27, San Bernardino Meridian, City of Carlsbad, shown on file in the Planning Department as Exhibit A, dated 12/27/74; has been filed with the City of Carlsbad and referred to the Planning Comrniss and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of 1 City of Carlsbad and has provided the necessary information which insures Put Facil i ties will be available and current with need; and WHEREAS, the subject application has complied with the requirements of City of Carlsbad "Environmental Protection Ordinance of 1972", because the project was covered by the EIR for the Ayers Master Plan application. It h been determined that a new EIR is not necessary since the project has not significantly changed from that anticipated in the Ayers Master Plan; and WHEREAS, said Commission considered all factors relating to the Tentati Map and found the following facts and reasons to exist: 1. The subdivision map m-ets all requirements of the subdivision map 2. The subdivision map meets all City policy and ordinance requireme] NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City ( Carl sbad as foll ows: A) That the above recitations are true and correct. B) That a tentative map is approved to a1 low a 307-lot subdivision 0' 92.8 acres on property located on the east side of Lagoon Lane be Poinsettia Lane and the Batiquitos Lagoon, and is subject to the fol 1 owing conditions : c 1 1) 2 3 4 2) 5 6 7 8 9 10 11 12 13 14 15 16 6) 17 3.8 19 20 21 22 23 24 25 26 27 28 29 30 31 32 3) 4) 5) 7) 8) 9) c 0 The Final Map shall be submitted for approval within one year from the final action by the City Council on the Tentative Su division Map. The final map shall be in substantial conforma of the tentative subdivision map known as Exhibit A, dated December 27, 1974. The development of the property described herein shall be sub to the restrictions and limitations set forth herein which ar addition to a17 the requirements, limitations and restriction all municipal ordinance and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose c preserving the residential characteristics of adjacent proper All pub1 ic improvements shall be made in conformity to the Ci Carlsbad Engineering Design Criteria and Standard Plans, the division Ordinance and other City Standards, to the satisfact of the City Engineer, without cost to the City of Carlsbad, a free of all liens and encumbrances. Improvement plans for wa and sewer systems shall meet the requirements of the respecti service districts. A1 1 land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and of all liens and encumbrances. No easements shall be recorde prior to approval of the final map unless approved by the Ci t Eng i neer . All utilities, including provisions for cable TV, shall be pl underground and/or shall be completely concealed from view. Ornamental street lighting shall be provided for as required Municipal Ordinance Code. The developer shall post a bond an or cash in the amount necessary to energize said street light for an eighteen month period after construction, to permit tl- incorporation of the subdivision into a maintenance district. This shall be done prior to approval of final map. The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site required by the City Engineer. The report and plan shall be prepared by Civil Engineers licensed by the State of Califorr and experienced in erosion control. Said Engineer shall cert that they have investigated the site and prepared data with f consideration of the consequences to the included and neighbc properties and conform to the standards of the Geological Saf Element of the General Plan. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants required fire flows and dry-stand pipes shall be installed pr to framing construction. Park-In-Lieu Fees shall be granted to the City concurrent wit City Council approval of the Final Map. A 25% reduction in t in-1 ieu fees will be allowed for the following dedications an improvements: a) The applicant shall offer to dedicate in fee title Lot 8 to the City concurrent with City Council approval of the Final Map. -2- r 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 b) The applicant shall offer to dedicate in fee title to the City the slope areas within lots 52-60 and 120-122 concur with City Council approval of the final map. Prior to tb City's acceptance of the dedication, the applicant shall install a fully automated sprinkler system and landscapin in a manner acceptable to the Parks and Recreation Direct c) A detailed landscape and irrigation plan for the 30' gree belt shown on the Lagoon Lane street section shall be sub mitted to the Parks and Recreation Director for approval This landscaping and irrigation shall be installed accorc to the phasing for Lagoon Lane, prior to occupancy of thc respective units. 10) A1 1 manufactured slopes with a slope ratio more than 3:l and i height more than 5 ft. shall be hydra seeded with quick growil plants as an interim for erosion control purposes. 11 ) Street names for the proposed subdivision are not acceptable i proposed. The appl icant shall provide a1 ternate street names Hibiscus Court and Camilia (sic) Circle and shall affix stree designations in accord with the City's adopted street naming pol icy. 12) The sanitary sewer system shall be designed in conformance wi the City of Carlsbad Standards to the satisfaction of the Cit Engineer . 13) The specific drainage plan shown on the tentative map is not approved. Cross-gutters will not be permitted at the inter- section of: Daisy and Rose, Daisy and Camelia, Daisy and Iri Orchid and Primrose. A revised drainage plan shall be submit to the City Engineer prior to Final Map consideration. 14) Slopes shall be 2:l maximum or as approved by the City Enginc 15) Alignment of Wisteria Circle in the vicinity of Lots 96 and 1 is not acceptable. A revised alignment shall be submitted tc City Engineer prior to Final Map consideration. 16) No Final Map will be approved until provisions are made to e the offsite sewer to connect to the existing Ponto sewer and construct the necessary pumping system; that is until plans approved and easements and bonds are received. 17) Necessary offsi te sewer and full-width Lagoon Lane improveme along Unit 1 frontage shall be constructed and their corresp ing easements dedicated as a condition of approval of Unit 1 The entire length of Lagoon Lane right of way within the sub division boundaries shall be dedicated with Unit 1. 18) The remaining full-width Lagoon Lane improvements shall be c structed as a condition of Unit 2. 19) A paved temporary turn-around shall be provided at any unit boundary where eight or more lots front on a street extensic created by that unit. 20) Dedication of Lagoon Lane shall include a waiver of direct i rights from lots shown on the final map, as abutting thereor Dedication of Daisy Avenue shall include a waiver of direct access rights from lots 50, 51 and 52, shown on the final mi abutting thereon. -3- .I I I 51 6~ 7 ~ 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ 0 0 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlst Planning Commission held on January 28, 1975, by the following vote, to wit: AYES : Commissioners Casler, Dominguez, Fikes, Jose, L'Heureux, Mats Wrench ~ NOES: None ABSENT: None ABSTAIN: None ~ , 1 1 1 ;;.( /' '4 ." j . ,).>{&-; -3 4 ,,~~ ,-~ f L i ,= ., c, ,,' 2 l" i. /K,J&l L ' - ,?
