HomeMy WebLinkAbout1975-01-28; Planning Commission; Resolution 1133/I 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1133 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE ON THE WEST SIDE OF MONROE STREET BETWEEN PARK DRIVE MAP TO ALLOW AN 8-LOT SUBDIVISION ON 2.36 ACRES LOCATED AND MAGNOLIA AVENUE. CASE NO. CT 74-23, APPLICANT: MICHAEL STRAUB (AGENT). WHEREAS, a verified application for a certain property, to wit: All that portion of Tract 253 of Thum Lands, recorded with the San Diego County Recorder on December 9, 1915, and further described in the files of the Planning Department; has been filed with the City of Carl sbad and referred to the P1 anning Cornmi: and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of City of Carlsbad and has provided the necessary information which insures Pu Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of City of Carlsbad "Environmental Protection Ordinance of 1972" because it is small and in an already developed portion of the City; and WHEREAS, said Commission considered all factors relating to the Tentati Map and found the following facts and reasons to exist: 1. The Tentative Map meets all requirements of the approved panhandlc variance for the subject property. 2. The Tentative Map meets all City Ordinance and Policy requirement! 3. The Tentative Map meets all requirements of the Subdivision Map Ac NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 0' Carlsbad as follows: A) That the above recitations are true and correct. B) That a Tentative Map is approved to allow an 8-lot subdivision, on 2.36 acres located on the west side of Monroe Street between Park Drive and Magnolia Avenue, and is subject to the following condit 1 ) The Final Map shall be submitted for approval within one yea from the final action by the City Council on the Tentatave 5 division Map. The Final Map shall be in substantial conforrr of the Tentative Subdivision Map known as Exhibit By dated January 22, 1975, on file in the Planning Department. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I e 0 2) 3) 4) 5) 6) 7) 8) 9) 10) 11 1 12) The development of the property described herein shall be sut to the restrictions and limitations set forth herein which ay addition to all the requirements, 1 imitations and restrictior all, municipal ordinance and State and Federal statutes now ir force, or which, hereafter, may be in force for the purpose c preserving the residential characteristics of adjacent proper All public improvements shall be made in conformity to the Ci of Carlsbad Engineering Design Criteria and Standard Plans, 1 Subdivision Ordinance and other City Standards, to the satisl ion of the City Engineer, without cost to the City of Carlsbi and free of all liens and encumbrances. Improvement plans fc water and sewer systems shall meet the requirements of the respective service districts. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and of a1 1 1 iens and encumbrances. No easements shall be record€ prior to approval of the Final Map unless approved by the Cit Eng i neer . All utilities, including provisions for cable TV, shall be pl underground and/or shall be completely concealed from view. In order to provide for reasonable fire protection during thc construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants required fire flows and dry-stand pipes shall be installed PY to framing construction. Park-In-Lieu Fees shall be granted to the City concurrent wit City Council approval of the Final Map. Street trees, when required by the City, shall be installed b the applicant at his expense. Trees shall be of a type appro by the Parks Department and shall be installed to their speci cations. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It s be the responsibil i ty of the applicant to make a1 1 arrangemen with the Parks Department concerning the requirements of this condition. These arrangements are to be made prior to approv of the Final Map. An additional 9' right of way along the subdivision boundary joining Park Drive shall be dedicated concurrent with City Council approval of the Final Map. Property line radius at P and Monroe shall be 20' . The developer shall construct complete half street improvemen for Monroe Street and Park Drive prior to the issuance of building permits. Prior to the construction of Monroe Street improvements, the applicant shall relocate all existing trees which abut the su division. The trees shall be moved to the right of way's westerly boundary, in a location where they will not disrupt pub1 ic improvements. Lot 1 access rights to Monroe and Park shall be dedicated, ex along the southeasterly 50' adjoining the Park Drive right of way. -2- li e 0 1 2 3 I 4 5 13) The City will not accept the proposed 40' wide drainage and se\ easement at the southerly boundary of Lots 1, 3 and 5 for publ. maintenance.
