TO LOCATED ON THE NORTH SIDE OF MAGNOLIA AVENUE BETWEEN APPLICANT: ALBERT J. AND JEAN FREIBURGER 20 FT. FOR A PROPOSED PANHANDLE LOT ON R-1 PROPERTY ~ ADAMS STREET AND HIGHLAND DRIVE. CASE NO. V-248, I I 1 j i WHEREAS, a verified application for a certain property, to wit: Portion of Tract 240, Thum Lands , Map 1681 , City of Carl sbad , and addressed as 1272 Magnolia Avenue, and further described in the files of the Carlsbad City Planning Department; ~ I has been filed with the City of Carlsbad and referred to the Planning Commi and WHEREAS, said verified application constitutes a request as provided t Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on April 8, 1975; and WHEREAS, the applicant has complied with the Public Facility Pol icy 01 the City of Carlsbad and has provided the necessary information which insu Public Facilities will be available and current with need; and WHEREAS, the subject application is exempt from the requirements of t City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard, s Commission considered all factors relating to the Variance and found the following facts and reasons to exist: 1. There are exceptional circumstances applicable to the property t do not apply generally to other properties in the same area sinc the subject property is extremely deep and relatively narrow anc only possible method for division is panhandle lot division. 2. The Variance is necessary for the preservation of a property ri! possessed by others in the same area, since other panhandle lot variances have been approved in the general area. 3. Granting of this Variance will not adversely affect the comprehen: General Plan, since the lots being created are of lower density tl might be allowed within the Land Use Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City ( Carlsbad as follows: A) That the above recitations are true and correct. B) That a Variance is approved to allow a reduction of minimum stree frontage from 60 ft. to 20 ft. for a proposed panhandle lot on R- property located on the north side of Magnolia Avenue between Ada Street and Highland Drive, and is subject to the following condit 1) No structures shall be constructed that would preclude the f development of a 30 ft. half street on the northern portion the possible division of one additional 7500 sq. ft. lot.
