RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING ldITHOUT PREJUDICE THE REQUEST FOR A PREANNEXATIONAL ZONE CHANGE FROM
THE EAST SIDE OF EL CAMINO REAL APPROXIMATELY 2500
JOHN MAMAUX, FOR WILLIAM CANNING, C.W.C. DEVELOPMENT COMPANY
COUNTY E-1-A TO RD-M ON A 13.9 ACRE SITE LOCATED ON
FT. NORTH OF ALGA ROAD. CASE NO. ZC-153, APPLICANT:
WHEREAS, a verified application for a certain property, to wit:
Parcel A, West Half of M. E. Quarter, Survey 26, Township 12 South, Range 4 West, San Bernardino Meridian, County of San
Diego, and further described in the files of the Carlsbad City Planning Department;
has been fi 1 ed with the City of Carl sbad and referred to the P1 anning
Commission; and
WHEREAS, said verified application constitutes a request as provided b:
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on April 8, 1975; and
WHEREAS, the subject application has complied with the requirements of
City of Carl sbad "Environmental Protection Ordinance of 1972" ; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, sa
Commission considered all factors relating to the Zone Change and found the
following facts and reasons to exist:
1. The applicant has not complied with the Public Facility Policy of the City of Carlsbad and has not provided the necessary informati which insures Public Facilities will be available and current wil need :
a) Leucadia County Water District has not provided the necessat evidence that they could provide sewer service.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carl sbad
Planning Commission held on April 8, 1975 by the following vote, to wit:
