RESOLUTION OF THE PLANNIMG COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE SPECIFIC PLAN TO ALLOW DEVELOPMENT OF 156 DWELLING UNITS ON
THE SOUTH SIDE OF PARK DRIVE BETWEEN MARINA DRIVE AND NEBLINA DRIVE, FRONTING ON THE NORTH SHORE OF THE
RACA DEVELOPMENT COMPANY.
AN 8-ACRE PIECE OF LAND ZONED P-C AND LOCATED ON
AUGA HEDIONDA LAGOON. CASE NO. SP-168, APPLICANT:

WHEREAS, a verified application for a certain property, to wit:
That parcel of land lying in Lot "I", Rancho Agua Hedionda, City of Carlsbad, according to Map thereof No. 823, as recorded in the office of the San Diego County Recorder, December 15, 1896, and further described in the files of the Carlsbad City Planning Department,
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on May 13, 1975; and
WHEREAS, the applicant has complied with the Public Facility Policy of .
City of Carlsbad and has provided the necessary information which insures
Public Facilities will be available and concurrent with need; and
WHEREAS, the subject application has complied with the requirements of '
City of Carlsbad "Environmental Protection Ordinance of 1972". An Environ-
mental Impact Report was certified by Planning Commission on April 22, 1975
based on the following justifications:
1) Compliance with all CEQA requirements.
2) Compliance with the requirements of the Carlsbad Environmentaf Protection Ordinance.
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, sa'
Commission considered a11 factors relating to the Specific Plan and found tl
following facts and reasons to exist:
1) The adverse environmental impacts of the project have been mitigatc in the fol lowing manner:

a) Visual access to the lagoon has been preserved through project design .
b) Physical access to the lagoon is ensured through provision of three pub1 ic wal kways.
c) Siltation of the lagoon will be controlled through prohibition grading during rainy months and planting of erosion control ve tation at the earliest possible date.
6 2) The project meets all standards for uses in the Planned Community
7 3) The project complies with the General Plan in the following manner
8 a) It complies with the density requirements of the Land Use Elem

b) It preserves the scenic and recreational amenities of the lago as required by the Open Space and Conservation Elements.
c) It provides for a bicycle corridor and preservation of scenic vistas along Park Drive as required by the preliminary Scenic Highways and Circulation Elements.
4) The project has been assured the availability of Public Facilities by the City Engineer and Carlsbad Unified School District.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City o

B) That a Specific Plan is approved to allow development of 156 dwell units on an 8-acre piece of land zoned P-C and located on the sout side of Park Drive between Marina Drive and Neblina Drive, frontin on the north shore of the Agua Hedionda Lagoon, and is subject to following conditions:
1 ) The approval is granted for land described in the application and attachments thereto, and as shown on the plot plan, labeled Exhibi A, the elevations labeled Exhibit 8, the garage plan labeled Exhib C and the floor plan labeled Exhibit D, all of which are dated 3/14/75. All buildings, roadways, landscaping, parking, building sitings and other features shall substantially conform to these exhibits.

2) Unless a final subdivision map is recorded for the project within thirty months of this approval, the Specific Plan shall become nul and void.

3) All requirements of any law, ordinance or regulation of the State California, City of Carlsbad, and any other governmental entity sh be compl ied wi th.

4) Any mechanical and/or electrical equipment to be located on the ro of the structure shall be screened in a manner acceptable to the Planning Director. Detailed plans for said screening shall be sub mitted, in triplicate, to the Planning Director. 30

5) A detailed landscape and sprinkler plan prepared by a landscape architect shall be submitted to the Parks and Recreation Director for consideration and approval.

All utilities, including electrical , telephone and cable televisio shall be installed underground and/or shall be completely conceale from view.
Any phasing of this project shall require an amendment to this Specific Plan.
The applicant shall install permanent bicycle parking facilities a the termini of Marina Drive and the cul-de-sac on the east side of the property. Said facilities shall meet the specifications of th Parks and Recreation Director and the City Engineer.
Driveways shall have a 24-ft. clear width. Minimum width of pavir at parking areas shall be 44 or 64 ft. (one or two 20-ft. stalls, plus 24-ft. aisles). Parking at the top of garage ramps is not a1 1 owed.
Adequate facilities, clearances and maneuverability for trash remc and emergency vehicles shall be provided.
All structures shall observe a 35-ft. height limit as defined by 1 Uniform Building Code, with the exception of the eight "loft area: whose location is depicted on the plot plan, Exhibit A, and whose dimensions shall conform to those shown on the elevations, Exhibil In no case shall the "loft areas'' measure more than 41 ft. in heic as defined by the Uniform Building Code.
Adequate fire protection shall be ensured through a combination 01 fire resistant building design materials and construction of watev mains and hydrants. This shall be accomplished in a manner accepl able to the Building Department.
The applicant shall submit for review and approval by the Plannin! Director a plan for recreational facilities on the site prior to . issuance of building permits. The recreation plan shall include i recreation area for children. All recreational structures and apl tenant facilities shall be placed so that they do not obscure the view of the lagoon.
Prior to issuance of a grading permit, the applicant shall submit for the City Engineer's review and approval a detailed soils stud; prepared by a qualified soils engineer. This study shall:
a) Determine the soil stability and height of the water table 0' the entire property.
b) Recommend any engineering solutions necessary to stabilize structures and prevent flooding of the subterranean garages.
Right of way shall be dedicated to provide a 42-ft. half street section for Park Drive and public frontage improvements shall be constructed as required by the City Engineer. Rights of access t Park Drive shall be waived. A pedestrian way and separate public bikeway shall be provided within the 10-ft. parkway and 15-ft.
building setback.
Right of way shall be dedicated and public frontage improvements shall be constructed along Marina Drive to provide a 40-ft. curb- curb dimension, plus a 7-ft. parkway. The intersection of Park Drive and Marina Drive shall be realigned to avoid acute turning movements and to provide a free right-turn movement on to Park Dr in accordance with City standards. A 15-ft. easement and improve walkway from Marina Drive to the lagoon shall be dedicated.

The driveway shall intersect Park Drive at a right ang' to the center1 ine. An improved public walkway to the lagoon shal' provided.
18) Pub1 ic walkway shall be dedicated and improved to City standards along the toe of the slope to the lagoon and above the mean high ' (Therefore, the walkway will be inundated only during a flood).
19) All public walkways on the project shall be lighted and barred to motor vehicles. This shall be accomplished in a manner acceptabll to the Police Chief and City Engineer.
20) Erosion control and slope planting shall be to the satisfaction o the City Engineer pursuant to such standards as the City may adop

Planning Commission held on May 13, 1975 by the following vote, to wit:
