HomeMy WebLinkAbout1975-05-13; Planning Commission; Resolution 11541 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 0 I I , PLANNING COMMISSION RESOLUTION NO. 1154 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO AN AMENDMENT TO TITLE 21 OF THE MUNICIPAL CODE, CHAPTERS 21.26 AND BY CONDITIONAL USE PERMIT IN CERTAIN LIMITED CIRCUMSTANCES. 21.28: RESIDENTIAL USES IN THE C-1 AND C-2 ZONES WHEREAS, the Planning Commission declared its intention to recommend t the City Council an Amendment to Chapters 21.25 and 21.28 of the Municipal ~ Code; and WHEREAS, the Planning Commission did hold a duly noticed Public Hearin ~ to consider the subject amendment; and WHEREAS, the Planning Commission received all testimony from those per ’ interested in and opposed to the proposed Zone Code Amendment; and I ~ WHEREAS, the Planning Commission did find the following facts and rea! to be present which in their opinion are necessary to carry out the genera’ purpose of Title 27 of the Carlsbad Municipal Code: ~ I through a Conditional Use Permit will insure compatible developml 1) Requiring review of residential development in commercial zones and protect the necessary residential environment and amenities. 2) The amendment will promote the implementation of the General Pla better defining use districts and providing protection to reside uses. NOM, THEREFORE, BE IT RESOLVED by the Planning Connnission of the City Carlsbad that it does recommend approval to the City Council the changes IT in Chapters 21.26 and 21.28 of the Municipal Code to allow residential USE the C-1 and C-2 Zones by Conditional Use Permit in certain limited circum- stances, those particular changes being shown in Exhibit A attached. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carl Planning Commission held on May 13, 1975, by the following vote, to wit: AYES : Commissioners Fikes, Jose, L’Heureux, Packard, Watson, Wrer f-”. ABSENT: ATTEST : Commissioner Dominguez
